On the afternoon of September 23, the National Assembly Standing Committee gave opinions on the draft amended Law on Handling of Administrative Violations (VPHC).
Presenting the report, Senior Lieutenant General Pham The Tung - Member of the Party Central Committee, Deputy Minister of Public Security - said that the drafting of the law aims to improve the effectiveness and efficiency of handling administrative violations, contributing to ensuring discipline and order in state management in all fields.
Notably, in the draft law, the Government proposes to supplement measures to enforce new sanctioning decisions.
Specifically, temporary exit suspension for individuals and legal representatives of organizations who have not fully complied with the administrative violation penalty decision and consider it necessary to immediately prevent that person from escaping.
Sealing headquarters, locations, establishments or parts of production, business, and service establishments is applied to enforce the form of sanctioning, revoking the right to use licenses, professional certificates, temporarily suspending operations for a limited time and enforcing remedial measures.
The request to stop the provision of electricity and water services for works, production facilities, businesses, and services is applied to enforce the penalty form of revoking the right to use licenses, professional certificates, temporarily suspending operations for a limited time and enforcing remedial measures.
Temporarily suspend vehicle registration; temporarily suspend vehicle registration; temporarily suspend the issuance of vehicle driving licenses are applied to enforce decisions on administrative violations in the fields of road traffic order and safety, railway traffic, inland waterway traffic, maritime traffic, and civil aviation activities.
Request to stop providing Internet services, telecommunications services, digital infrastructure or implement technical prevention measures, block access to organizations and individuals who do not comply with the form of penalty of revoking the right to use licenses, professional certificates, suspending operations for a limited time, and remedial measures on the electronic environment according to the provisions of law.
The draft also supplements the conditions for applying coercive measures and cases not subject to coercion to ensure the contents directly related to human rights and citizen rights specified in the law.
Senior Lieutenant General Pham The Tung said that there are opinions suggesting a thorough assessment of the necessity and impact of coercive measures to stop providing internet, telecommunications, and digital infrastructure services because they may directly limit the rights and interests of individuals and organizations.
However, the drafting agency found that the addition of this coercive measure is necessary, meeting practical requirements, ensuring coercion against organizations and individuals who do not comply with additional penalties and remedial measures in the electronic environment.
Preliminary verification, Member of the Party Central Committee, Chairman of the Law and Justice Committee Phan Chi Hieu clearly stated that the Standing Committee of the Law and Justice Committee found that some new coercive measures proposed to be added to the draft Law are measures aimed at suspending and ending violations, not really suitable for the nature of coercive enforcement of sanctioning decisions.
Along with that, the measure of temporarily suspending vehicle registration, temporarily suspending vehicle registration, temporarily suspending the issuance of vehicle driving licenses only aimed at vehicles and assets instead of individualizing and correctly identifying the violator is a solution that is not really fundamental and comprehensive.
Therefore, it is proposed to continue reviewing and revising these provisions of the draft law to ensure suitability and feasibility.
