On the morning of November 7, continuing the program of the 10th Session, the National Assembly listened to Minister of Finance Nguyen Van Thang present a summary of the Draft Law on Planning (amended) and adjustment of the National Master Plan for the period 2021-2030, with a vision to 2050.
One of the notable new points of the draft law is the proposal to decentralize the Prime Minister to approve the planning of the marine space and national land use.
According to Minister of Finance Nguyen Van Thang, the draft Law on Planning (amended) has completed regulations on the planning system.
Specifically: National-level planning (National master plan, national marine space planning, national land use planning, industry planning); Regional planning; Provincial planning; Industry detailed planning; Urban and rural planning; Special administrative - economic unit planning prescribed by the National Assembly.
The list of industry planning and detailed industry planning will also be reviewed and the number of plans will be reduced.
According to the Minister of Finance, the number of plans has been reduced from 78 plans to 49 plans, a decrease of 37%.
At the same time, the draft law decentralizes to the Prime Minister for approval of national marine spatial planning and national land use planning.
The Government is expected to be assigned detailed regulations on the authority to approve industry planning to ensure flexibility in direction and management.
The draft law also decentralizes to ministers to approve detailed plans for sectors; Chairman of the Provincial People's Committee to approve provincial planning.
To ensure post-inspection work; limit arbitrary planning adjustments, Mr. Thang said that the draft law supplements regulations on supervision, inspection, and planning review.
In addition, the draft law also adds provisions to remove difficulties and obstacles related to assessing the suitability of investment projects with planning.
Reviewing this content, Chairman of the Economic and Financial Committee Phan Van Mai said that the Committee agreed to amend and approve the Draft Law on Planning and Investment according to shortened procedures and order.
Regarding decentralization of authority to the Prime Minister to approve national land use planning, national marine space planning, and assign the Government to regulate the authority to approve industry planning, the Chairman of the Economic and Financial Committee said that the National Assembly Standing Committee has reached a conclusion.
The Government has reported, but has not clarified the specific difficulties and problems of submitting to the National Assembly for decision on National Land Use Planning and National Sea Space Planning according to current regulations, leading to the need for amendments as in the draft law.
In addition, it is not clear whether the regulations on regional planning approved by the Prime Minister must ensure "compliance" with sectoral planning, including sectoral planning approved by the minister.
The Chairman of the Economic and Financial Committee said that many opinions in the inspection agency said that the regulations on assessing the project's suitability with the planning are still complicated. According to these opinions, it is necessary to study the regulations on which planning authority decides which planning is used to assess the project's suitability with the planning.
When assessing the suitability of an investment project to implement an investment project, only based on the most direct planning and that planning must have a role and legal value as a specific administrative management tool.
