The Ministry of Home Affairs is seeking opinions on the draft Decree to replace Decree No. 131/2021/ND-CP of the Government detailing and measures to implement the Ordinance on Preferential Incentives for People with meritorious services to the Revolution.
Notably, in the Draft Decree, the Ministry of Home Affairs reserves 2 articles to regulate the authority and basis for granting victim certificates.
Regarding the basis for granting a victim certificate, the Ministry of Home Affairs proposes that for the victim certificate prescribed in Point a, Clause 1, Article 14 of the Ordinance, the issuance of a victim certificate must be based on the confirmation of the following agencies and units:
The victims are officers, professional soldiers, non-commissioned officers, soldiers, defense civil servants, workers and defense officials assigned by the battalion commander and equivalent; the victims are people working in cryptography, people working in other cryptographic organizations and cryptographic students under the Government cryptography Department assigned by the head of the unit under the agency or unit under the Department.
In particular, the victims are officers, non-commissioned officers, soldiers, workers, and contract workers with an indefinite period of salary from the budget in the police issued by the Commune-level Police Chief.
The victim belongs to a central agency headed by a department or equivalent.
The victim who is not subject to the above regulations shall be issued by the Chairman of the People's Committee at the commune level.
Regarding the authority to issue a certificate of sacrifice, the draft Decree clearly states that the victims are officers, professional soldiers, non-commissioned officers, soldiers, defense civil servants, workers and defense officials certified by the regimental commander or equivalent or higher;
The victim is a person working in a cryptographic organization, a person working in another cryptographic organization, and a cryptographic trainee under the Government committees, certified by the head of the unit under the committees or higher.
The victims are officers, non-commissioned officers, soldiers, workers, and contract workers who do not have a fixed period of salary from the police budget, which is certified by the head of a unit under the Ministry or the Director of the provincial police.
The victim is a central agency granted a certificate by a Minister or equivalent.
The victim is under the management of a provincial agency and the victim is under the management of a district agency before July 1, 2025, which will be certified by the Chairman of the Provincial People's Committee.
The victim is a commune-level agency and the cases paid in the area are not specified in Clauses 1, 2, 3, 4 of this Article and are certified by the Chairman of the People's Committee at the commune level.
