On the morning of November 21, the National Assembly discussed in the hall the draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
Many opinions expressed agreement with the need to issue a resolution.
Regarding the area of national defense and security land in the draft resolution, delegate Phan Duc Hieu (Thai Binh Delegation) proposed to separate this content into a separate resolution specializing in piloting commercial housing for armed forces, within the pilot development of commercial housing in general through an agreement on receiving land use rights or having land use rights.
Delegate Nguyen Tao (Lam Dong Delegation) also proposed separating this content into a separate resolution to make it more feasible and coherent.
Meanwhile, delegate Nguyen Minh Tam (Quang Binh Delegation) said that in Clause 3, Article 3 of the draft Resolution, it is stipulated that "For the area of national defense land and security land that has been planned to be removed from national defense land and security land, in accordance with construction planning, urban planning, housing development programs and plans, priority will be given to the Ministry of National Defense and the Ministry of Public Security to organize the implementation of commercial housing projects for sale to officers and soldiers of the armed forces according to the provisions of law and not to arrange and handle public assets according to the provisions of law on management and use of public assets".
However, according to delegates, the draft Resolution does not limit the conditions (area, project scale, etc.) which is too broad.
The delegates suggested that the drafting agency organize an assessment and survey of the demand for land use for housing in general and the demand for commercial housing in particular within the management force of the Ministry of National Defense and the Ministry of Public Security to advise the Government to submit to the National Assembly reasonable regulations, ensuring reasonable land use, suitable to needs and effective in practice.

There is a document from the Ministry of National Defense or the Ministry of Public Security approving the real estate business organization to receive the transfer of land use rights for defense land, security land or land area originating from defense land or security land to implement commercial housing projects in accordance with the approved land use planning for housing development in the case of projects implemented in the form of receiving land use rights.
