Ms. Le Ngoc Minh (Dong Nai) was born in December 1968 and has been working since February 1984. Currently, she is the Deputy Director of the Center for Culture - Information and Sports of a district in Dong Nai province.
Ms. Minh wishes to retire early according to Decree 29/2023/ND-CP of the Government.

Regarding the reflection and recommendation of Ms. Le Ngoc Minh, the Ministry of Home Affairs said: According to Article 5 of Decree 29/2023/ND-CP, the early retirement age for cadres subject to staff reduction according to the provisions of law is prescribed as follows:
The subjects of staff reduction must be at least 5 years younger than the maximum and 2 years younger than the minimum, and must have paid 20 years or more of compulsory social insurance.
Including 15 years of working in a heavy, toxic, dangerous or especially heavy, toxic, dangerous job or 15 years or more working in an area with especially difficult socio-economic conditions, including working time in an area with a regional allowance coefficient of 0.7 or higher before January 1, 2021.
The subjects of staff reduction must be at least 5 years younger than the maximum and at least 2 years younger than the retirement age and have paid at least 20 years of compulsory social insurance; The subjects of staff reduction must be at least 2 years younger than the retirement age and have paid at least 20 years of compulsory social insurance, including at least 15 years of working in arduous, toxic, dangerous or especially arduous, toxic, dangerous occupations or jobs, or at least 15 years of working in areas with particularly difficult socio-economic conditions, including working time in areas with regional allowance coefficient of 0.7 or higher before January 1, 2021.
The subjects of staff reduction are those whose minimum age is 2 years lower than the retirement age and have paid 20 years or more of compulsory social insurance (female cadres and civil servants at the commune level have paid 15 years or more of compulsory social insurance); The subjects of staff reduction are female cadres and civil servants at the commune level who are at least 5 years lower than the maximum age and at least 2 years lower than the minimum age and have paid 15 years to less than 20 years of compulsory social insurance.
Comparing the above regulations, in order to retire early according to the staff reduction policy stipulated in Decree No. 29/2023/ND-CP, in addition to the condition of social insurance payment period, other conditions are also required (age by gender, development of working time showing job title, etc.).
At the same time, the pension benefit file must show that the employee has been approved by the direct management unit and the competent authority for early retirement due to staff reduction.
