In particular, Resolution 66-NQ/TW clearly states the requirement to innovate thinking and orient law-making in the direction of both ensuring the requirements of state management and encouraging creativity, liberating all productive forces, and unlocking all development resources.
The work of law-making must fully, correctly and promptly institutionalize the Party's guidelines and policies, stemming from the interests of the whole country, making institutions and laws a competitive advantage, resolutely abandoning the mindset of "if you can't manage, then ban"; promoting democracy, respecting, ensuring, effectively protecting human rights and civil rights, ensuring balance and reasonableness between the level of limitation of rights and legitimate benefits achieved.
The provisions of the law must be stable, simple, easy to implement, with people and businesses as the center. Properly promote the role of social ethics, professional ethics, and community self-management rules in regulating social relations.
Respect and proactively research strategies and policies early, from practice, from world experience, contributing to enhancing predictability and improving the quality of law-making work. Ensure the process of developing and promulgating democratic, professional, scientific legal documents, in a timely, feasible, and effective manner, clearly defining the policy making process and the document drafting process; gradually implementing the drafting of legal documents in a centralized and professional manner.
Activities of summarizing, surveying practices, researching international experiences, assessing policy impacts, and selecting policies must be carried out carefully, substantially, and scientifically. Strengthen policy communication, especially policies that have a great impact on society, people, and businesses.
Strictly implement the mechanism of receiving and explaining comments from affected subjects, not causing difficulties for people and businesses in policy design and law making.
In addition to some laws and laws regulating human rights and civil rights, legal proceedings need to be specific, basically other laws, especially the law regulating the contents of development creation, only regulate framework issues, issues of principle under the authority of the National Assembly, while practical issues that are often subject to change are assigned to the Government, ministries, branches and localities to regulate to ensure flexibility and suitability with reality.
