Ms. Tran Thi Bich Phuong is a representative of an insurance company. Ms. Phuong questioned the legal value of driver's license information on the VNeID application. Ms. Phuong raised two cases:
1. In case a driver loses his PET material driving license, when participating in traffic, he only uses the driving license information on VNeID, and causes a traffic accident by driving. So according to the law, is the driver guilty of not having a driving license?
2. In case the driving license information has been updated on the VNeID application according to Point a, Clause 24, Article 4, Circular 05/2024/TT-BGTVT, when participating in traffic, can the driving license information on the VNeID application be used to replace the driving license made of PET material?
Responding to this content on the Electronic Information Portal, the Ministry of Public Security said:
According to Point a, Clause 24, Article 4, Circular No. 05/2024/TT-BGTVT dated March 31, 2024 of the Ministry of Transport amending and supplementing a number of articles of Circulars related to the field of road transport, road transport support services, vehicles and drivers, effective from June 1, 2024:
A valid PET material driving license is a driving license issued by a competent authority, with the blank number, date of issue, and expiration date printed on the driving license matching the blank number, date of issue, and expiration date in the driving license management information system or with driving license information that has been authenticated on VNeID.
Based on the above regulations, the driver's license information verified on VNeID is valid and can be used to replace the PET material driver's license when participating in traffic.
In case a driver loses his PET material driving license, when participating in traffic using the driving license information that has been verified on VNeID, the driver does not violate the error of "No driving license" or "Not carrying a driving license".
