This content is stipulated in Decree No. 55/2026/ND-CP of the Government amending and supplementing many new regulations on sanctioning administrative violations in the field of public asset management.
To be consistent with the Law on Handling of Administrative Violations in 2020 and the Law on Inspection in 2025, Decree No. 55/2026/ND-CP has amended and supplemented Article 30 in the direction of adjusting the sanctioning authority of titles.
Accordingly, the authority to sanction administrative violations of titles in the field of public asset management is regulated as follows:
Director of the Department of Public Asset Management; Heads of organizations under ministries and ministerial-level agencies assigned to perform inspection tasks within the scope of state management of ministries and ministerial-level agencies; Heads of inspection teams established by Ministers and Heads of ministerial-level agencies have the power to: Issue warnings; fine up to 100,000,000 VND; confiscate exhibits and means of administrative violations; apply remedial measures.
Directors of Departments; Heads of inspection teams headed by Heads of organizations under ministries and ministerial-level agencies performing state management tasks of ministries and established ministerial-level agencies have the right to: Issue warnings; fine up to 80,000 VND; confiscate exhibits and means of administrative violations; apply remedial measures.
The Decree also supplements regulations on sanctioning violations of regulations on exploitation of public assets at agencies, organizations, and units.
Accordingly, organizations that exploit public property without being issued a decision to exploit public property by a competent agency or person as prescribed shall be fined from 1,000,000 VND to 5,000,000,000 VND.
This Decree takes effect from February 9, 2026.
For administrative violations in the field of public asset management, national reserves, and state treasury that occurred before the effective date of this Decree and are subsequently discovered or are being considered and resolved for administrative sanctions, the sanctioning regulations are applied according to the provisions of this Decree.
Abolishing Clause 11, Article 4 of Decree No. 102/2021/ND-CP dated November 16, 2021 of the Government amending and supplementing a number of articles of Decrees on sanctioning administrative violations in the fields of tax, invoices; customs; insurance business, lottery business; management and use of public assets; practicing thrift, combating wastefulness; national reserves; state treasury; independent accounting and auditing.
