This is a notable content in the Draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under provincial levels assessed by the Ministry of Justice.
According to the Ministry of Home Affairs - the drafting agency, the working regime of the department and the responsibilities of the Department Director are clearly stated in Article 7 of the Draft Decree.
Accordingly, departments under the Provincial People's Committee operate under the head regime and the Working Regulations of the Provincial People's Committee, ensuring the principle of democratic centralism.
Based on legal regulations and the assignment of the provincial People's Committee, the department director issues the Department's Working Regulations and directs and inspects the implementation.
The Director of the Department is responsible to the People's Committee and Chairman of the Provincial People's Committee for performing the functions, tasks, and powers of state management of sectors and fields in the locality and the tasks assigned or authorized by the People's Committee and Chairman of the Provincial People's Committee; not transferring the work under his/her duties and powers to the People's Committee and Chairman of the Provincial People's Committee.
For issues beyond the authority or within the right authority but not capable and qualified to be resolved, the Department Director must proactively work with the Director of the relevant Department to complete the dossier to submit to the People's Committee and the Chairman of the Provincial People's Committee for consideration and decision; practice thrift, combat waste and be responsible for corruption and damage in organizations and units under his/her management.
Also according to the Ministry of Home Affairs, the Director of the Department is responsible for reporting to the People's Committee, Chairman of the Provincial People's Committee; Ministries and ministerial-level agencies on the organization and operation of their agencies; reporting work to the Provincial People's Council when required; providing necessary documents as requested by the Provincial People's Council; responding to voters' recommendations and questions from Provincial People's Council delegates on issues within the scope of management and fields; coordinating with other Department Directors, heads of socio-political organizations, and relevant agencies in performing the department's tasks.
Notably, the Department Director is responsible for appointing, transferring, rotating, rewarding, disciplining, giving resignation, implementing regimes and policies for heads and deputy heads of agencies and units under and directly under according to regulations and decentralizing the management of local cadres.
