This is to enhance the responsibility of local authorities at the provincial level in ensuring the implementation of the tasks and powers of local authorities at the commune level (Clause 4, Article 11).
According to Clause 4, Article 11, the decentralization, regulation of tasks and powers of local authorities and agencies of local governments in legal documents must comply with the provisions of this law, ensuring effective control of state power.
In case of necessity, the People's Committee and the Chairman of the provincial People's Committee directly directs and manages the settlement of issues under the tasks and powers of the specialized agencies and other administrative organizations under their People's Committee, the People's Committee and the Chairman of the People's Committee of the commune.
According to Chairman Hoang Thanh Tung, there needs to be a more flexible mechanism for assigning and authorizing so that the People's Committees at the commune level can assign to other specialized agencies, administrative organizations, and even civil servants under the People's Committees at their level to perform a number of tasks and powers in accordance with the actual requirements and conditions of the locality.
Continue to review and revise regulations on specific tasks and powers of People's Councils (PCs), People's Committees, and Chairmen of People's Committees at all levels in the draft law to more clearly demonstrate the policy of promoting decentralization and delegation of power, ensuring a reasonable determination of the tasks and powers of local authorities at the provincial and commune levels.
Continue to clarify the specific tasks and powers of local authorities at the provincial and commune levels in each specialized field, especially the laws expected to be submitted to the National Assembly at the 9th Session.
Continue to consider and adjust a number of regulations on organization and operation of local governments such as: The number and field of charge of the Committees of the People's Council of the commune level; the number of provincial and commune People's Councils; The tasks and powers of the Standing Committee of the People's Council are decided by the budget expenditure regime to perform a number of specific tasks in the area or perform urgent tasks under the direction of the competent authority.
Consider organizing specialized agencies and other administrative organizations under the People's Committees at the commune level to ensure compliance with local requirements and practices and the policy of streamlining the apparatus.

Regarding the number of provincial and commune People's Councils, the draft law is amended in the direction of increasing the number of provincial People's Council deputies (from the maximum of 75 to 90 delegates) and the commune People's Council (from maximum of 30 to 35 delegates) compared to the provisions of the current Law.
Through discussion, many members of the Legal and Judicial Committee agreed with the increase in the number of provincial and commune People's Councils to ensure consistent with the scale of the provincial and commune administrative units after arrangement; The method of calculating the number of People's Council deputies in each type of administrative unit in the draft law is relatively suitable and grounded.
However, there are also opinions that increasing the number of People's Council delegates is not really in line with the policy of streamlining the apparatus and reasonably reducing the number of People's Council delegates in the current period.
