In 2023, at the unit of Mr. Hoang Minh Hai (character's name has been changed), Ms. Nguyen Thi A (specialist) suffered from serious illness and had to take sick leave to receive social insurance benefits for continuous treatment for nearly 9 months (from February 7, 2023 to October 27, 2023).
In this case, the classification of cadres, civil servants and public employees is not assessed according to the provisions of Decree No. 90/2020/ND-CP dated August 13, 2020 of the Government.
Mr. Hai learned from Point a, Clause 2, Article 2 of Circular No. 08/2013/TT-BNV dated July 31, 2013 regulating the standard for regular salary increase:
First, being evaluated by competent authorities from the level of task completion but still having limited capacity or higher.
Second, do not violate any of the forms of reprimand, warning, demotion, or dismissal.
"I request the Ministry of Home Affairs to guide the consideration of regular salary increases for Ms. Nguyen Thi A in accordance with regulations" - Mr. Hai suggested.
Regarding Mr. Hai's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Accordingly, the regular salary increase regime is stipulated in Article 2 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regular salary increase regime and early salary increase for cadres, civil servants, public employees and workers (to date, it has been amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs).
Cases included in the time for considering regular salary increases are clearly stated in Article 2 of this Circular, including:
Time off work is entitled to full salary according to the provisions of the law on labor;
Time off to enjoy maternity benefits according to the provisions of the law on social insurance;
The combined time off for sick leave, work accidents, occupational diseases receiving social insurance is from 6 months or less ( duration of stay) according to the provisions of the law on social insurance;
The time is decided by the competent authority to send to work as an expert, study, internship, work, and survey in the country or abroad (including the time spent under the wife's regime, military service according to the Government's regulations) but is still on the salary payment list of the agency or unit.
The organization and implementation of policies for civil servants and public employees in Tien Giang province is under the authority of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs has asked Mr. Hai to contact the civil servant and public employee management agency of Tien Giang province (Department of Home Affairs) for answers.
