According to the Ministry of Home Affairs, Point d Clause 5 Article 1 Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs amending and supplementing the regime of regular salary increase, early salary increase and seniority allowance beyond the framework for cadres, civil servants, public employees and employees has specifically stipulated the extended period for consideration of regular salary increase.
In case of being assessed and classified as not completing assigned tasks and being disciplined, the extension period for regular salary increase is the total extension period specified in Points a, b and c of this Clause.
The organization and implementation of regimes and policies for cadres, civil servants, public employees and workers in provinces and centrally-run cities (provincial level) is under the authority of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs recommends that you contact the professional agency of the People's Committee of Quang Nam province (Department of Home Affairs) for answers.
According to Lao Dong reporter's research, Points a, b and c, Clause 5, Article 1 of Circular No. 03/2021/TT-BNV dated June 29, 2021 stipulates:
During the period of maintaining the current salary level, if the cadre, civil servant, public employee and employee has received a written notice or decision from the competent authority that they have not completed their assigned tasks annually or have been disciplined in one of the forms of reprimand, warning, demotion, or dismissal, the time for calculating the regular salary increase will be extended compared to the prescribed time in the following cases:
Extended by 12 months for the following cases: Cadres disciplined by dismissal; Civil servants disciplined by demotion or dismissal; Officials and employees disciplined by dismissal.
Extended by 6 months for the following cases: Cadres, civil servants and employees disciplined with reprimand or warning; Officials disciplined with warning; Cadres, civil servants, public employees and employees whose quality is assessed and classified by competent authorities as failing to complete assigned tasks annually; in case of failing to complete assigned tasks for 2 consecutive years during the period of holding the rank, each year of failing to complete assigned tasks will be extended by 6 months.
Extended 3 months for officials disciplined with reprimand.
