Mr. Vo Tri Thuc (Dong Thap) graduated from university with a major in Primary Education in 2016. In October 2016, he joined social insurance (SI) as a Grade IV Primary School Teacher, code V.07.03.09.
By the end of July 2018, he stopped participating in social insurance (had not received a lump sum social insurance payment). The total payment period was 1 year and 10 months (total 22 months).
In January 2022, he was recruited as a Grade III Primary School Teacher, code 07.03.29 and was exempted from probation according to Article 10 of Circular 15/2012/TT-BNV, Article 10 of Consolidated Document 07/VBHN-BNV dated July 3, 2019 and Clause 5, Article 21 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, use and management of civil servants.
Thus, after deducting the probationary period (12 months) with social insurance contributions, he has 10 months left to participate in social insurance according to the training industry or profession or according to the previous professional expertise.
According to Clause 3, Article 10 of Circular 15/2012/TT-BNV and Clause 3, Article 10 of Consolidated Document 07/VBHN-BNV dated July 3, 2019 of the Ministry of Home Affairs: The working time with compulsory social insurance payment of the recruited person who has done professional work suitable to the requirements of the recruited job position (if any) is counted in the time for considering salary increase the next time after appointment and salary classification into professional title.
"Will the remaining social insurance payment period (10 months) be counted towards the salary increase period?" - Mr. Thuc wondered.
Regarding the reflection and recommendation of Mr. Vo Tri Thuc, the Ministry of Home Affairs said: Pursuant to Clause 5, Article 13 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants (amended and supplemented at Point 5, Clause 7, Article 1 of Decree No. 85/2023/ND-CP dated December 7, 2023 of the Government) stipulates:
In case a person is recruited or accepted as a civil servant according to the provisions of this Decree and has previously worked for a period of time in accordance with the provisions of law and has paid compulsory social insurance (if not continuously and has not received a one-time social insurance benefit, it will be accumulated), that period will be calculated as the basis for salary classification according to the professional title appropriate to the recruited or accepted job position if all conditions are met according to regulations.
The Ministry of Home Affairs said that if he meets all of the above conditions, Mr. Thuc's working time will be used as a basis for appropriate salary arrangement.
