The Ministry of Home Affairs has reported on the progress of preparation and some major contents of the draft revised Law on Occupational Safety and Health (OSH).
According to the drafting agency, after nearly 10 years of implementation, the Law on OSH has created an important legal corridor to ensure the right to work in OSH conditions.
However, in the face of new requirements of industrialization, digital transformation, international integration and rapid development of the labor market, amending and supplementing the Law on OSH is necessary to overcome inadequacies.
At the same time, the amendment also aims to improve the effectiveness of state management and meet practical requirements in the new period.
The report of the Ministry of Home Affairs also clearly states some major contents in the draft Law (amended). In which, amending and supplementing regulations on state management in the field of OSH.
Implementing the policy of continuing to arrange the organizational structure of the political system, innovate the organization of local government and promote decentralization and delegation of power in state management, the draft Law has reviewed and amended regulations on state management in the field of OSH according to the following orientations:
Review and improve regulations on state management responsibilities in the field of OSH, ensuring compliance with the organizational model of the administrative apparatus after arrangement.
In particular, improve regulations on decentralization and delegation of power to local authorities at commune level in the field of OSH in the direction of clearly stipulating the responsibilities of commune-level People's Committees; commune-level basically performs tasks previously under the authority of the district level, and at the same time performs a number of new tasks decentralized and authorized from the provincial level.
Transferring some tasks from district level to commune level; adjusting the agency receiving declarations and reports on labor accidents from provincial-level specialized agencies to commune-level People's Committees.
In addition to perfecting regulations on state management, the draft Law also expands and clarifies the role of social representative organizations in OSH work.
Continue to stipulate the rights and responsibilities of the Vietnam Fatherland Front and member organizations of the Front.
Completing regulations on the rights and responsibilities of trade union organizations and grassroots trade unions.
Supplementing the role of the Vietnam Farmers' Union in implementing occupational safety and health activities for farming households, farms, cooperatives, craft villages and agricultural production facilities.
Supplementing regulations on the rights and responsibilities of the Vietnam Cooperative Alliance and professional associations to expand the network of support, propaganda, supervision and promote socialization of OSH work for the collective economic sector, business households and informal sector workers.
