Ms. Nguyen Thi Thanh Tam (name of the character changed) said that she is currently a deputy head of a professional department under the Ward People's Committee. From March 1, 2026, she was assigned by the Chairman of the Ward People's Committee to be in charge of the general unit because the unit does not have a head.
From the above reality, Ms. Thanh Tam wondered whether during the time she was assigned to be in charge of the unit, she would receive a position allowance equal to the level of the head according to the guidance in Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs or not.
Regarding Ms. Tam's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The Ministry of Home Affairs said that Point d1 Clause 2 Section II of Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs stipulates: People who have a decision (in writing) of a competent authority assigning responsibility or assigning powers to the head level (not yet a decision approving the election results or a decision appointing a leadership position) are entitled to a position allowance equal to the position allowance of the head level.
When there is a decision to terminate the assignment of responsibility or terminate the assignment of authority to the head level, the enjoyment of leadership position allowances of the head level is terminated from the date the decision takes effect.
The organization of policy implementation for cadres, civil servants, and public employees in provinces/cities is under the authority of the Chairman of the Provincial/City People's Committee.
Therefore, the Ministry of Home Affairs requests Ms. Tam to contact the agency managing cadres, civil servants, and public employees of provinces/cities (Department of Home Affairs) for answers.
