In order to implement the policy of streamlining the apparatus and improving operating efficiency, the Ministry of Home Affairs has just sent Official Dispatch No. 5691 to the People's Committees of provinces and cities.
This document provides detailed guidance on the arrangement and organization of public non-business units providing essential, multi-sectoral, and multi-field services at the commune level.
This arrangement closely follows the direction of the Central Steering Committee, specifically Resolution No. 18-NQ/TW and Resolution No. 105/NQ-CP issued on April 8, 2026. At the same time, the process of reorganizing or dissolving units must also strictly comply with Decree No. 283/2025/ND-CP (amended Decree 120/2020), which clearly stipulates the responsibilities of industry-managed ministries in issuing classification criteria and merger conditions.
Regarding job positions, the Ministry of Home Affairs said it is presiding over the drafting of a Decree regulating job positions for civil servants, an important stepping stone to bring the 2025 Law on Civil Servants into practice.
According to the draft decree, the Government will issue 3 lists of framework job positions including: Management civil servant job positions; professional and nghiệp vụ civil servant job positions and supporting civil servant job positions.
These lists will be applied uniformly in public non-business units in industries, fields and non-business units providing multi-industry and multi-field public non-business services at the commune level.
While the decree has not been issued, the Ministry of Home Affairs requests localities to base on the provisions of Decree No. 106/2020/ND-CP of the Government on job positions and the number of people working in public non-business units and guiding Circulars of ministries managing related industries and fields to develop and approve the Project on job positions in public non-business units of localities.
This is the basis for recruiting, managing, using, arranging, and evaluating civil servants according to requirements at each job position, in accordance with assigned functions and tasks.
After the decree is promulgated and takes legal effect, it is proposed that localities implement the adjustment, supplementation, and completion of the Project on job positions in public non-business units under their management scope to be appropriate.
