The Ministry of National Defense is seeking opinions on the draft Circular amending and supplementing a number of articles of Circular No. 86/2016/TT-BQP dated June 20, 2016 of the Minister of National Defense stipulating and guiding the organization of funerals for soldiers, workers, and civil servants of national defense; people working in key jobs managed by the Ministry of National Defense.
Accordingly, the draft Circular mentions the amendment and supplementation of Article 9 (Circular No. 86/2016/TT-BQP) as follows:
Article 9. Titles and ranks are organized for the High-Level Funeral.
1. Incumbent, retired or retired Army officers of one of the following positions and military ranks who sacrifice or pass away are entitled to hold a High-Level Funeral (if not subject to State-level Funeral), including:
a) Minister, Head of the General Department of Politics; Chief of the General Staff; Deputy Minister of National Defense; Senior Lieutenant General, Admiral of the Navy;
b) Member of the Party Central Committee (including Alternate Member), Member of the Central Military Commission;
c) Deputy Chief of the General Staff; Deputy Director of the General Department of Politics;
d) Heads, Political Commissars, Deputy Heads, Deputy Political Commissars of General Departments; Director General, Political Commissar, Deputy Director General, Deputy Political Commissar of General Department II;
e) Commander, Political Commissar, Deputy Commander, Deputy Political Commissar of Military Region, Military Service, Army Corps, Border Guard;
e) Director, Political Commissar, Deputy Director, Deputy Political Commissar of the National Defense Academy;
g) Lieutenant General, Deputy Admiral of the Navy, Major General, Rear Admiral of the Navy;
h) Revolutionary cadres who participated in revolutionary activities before January 1, 1945 (revolutionary veterans) were awarded the First-class Independence Medal or more; cadres who participated in activities in the South throughout the anti-American period (1954 - 1975) were awarded the First-class Independence Medal or more; outstanding social, cultural, and scientific activists (rewarded with the Ho Chi Minh Prize - individual award) and were awarded the First-class Independence Medal or more; outstanding social, cultural, and scientific activists (rewarded with the Ho Chi Minh Prize - individual award) who are Heroes of the People's Armed Forces, Labor Heroes.
2. For cases where a deceased cadre holds one of the positions specified in Clause 1 of this Article (if not a member of the Party Central Committee) but is disciplined by dismissal or removal of position or title, the funeral is organized according to the funeral ritual for military personnel with military ranks from Colonel or below or workers, civil servants, and public employees of national defense who are working or retired as prescribed in Chapter IV or Chapter V of this Circular.
3. For cases of deceased officials who are members of the Party Central Committee (except for positions held at the State level of Funeral) who have been dismissed from their positions, retired from work, retired early, retired according to regulations due to violations or shortcomings, the funeral is organized according to the Funeral ritual for military personnel with military ranks from Colonel or below or workers, civil servants, and public employees of national defense who are working or retired as prescribed in Chapter IV or Chapter V of this Circular.
