Resolution 66-NQ/TW clearly states that building and perfecting laws on the socialist-oriented market economy in the direction of building a favorable, open, transparent, safe legal environment with low compliance costs; thoroughly cutting and simplifying unreasonable investment, business, practice conditions, administrative procedures, promoting creative startups, improving a stable investment and business environment.
In essence, ensuring freedom of business, property ownership and contract freedom, equality between enterprises in all economic sectors, the private economy is the most important driving force of the national economy.
Create a legal basis for the private economic sector to effectively access resources on capital, land, and high-quality human resources, promote the formation and development of regional and global private economic groups; substantially and effectively support small and medium-sized enterprises.
Focus on building laws on science, technology, innovation and digital transformation, creating a legal corridor for new, unconventional issues (artificial intelligence, digital transformation, green transformation, exploitation of data resources, encrypted assets, etc.) to form new growth drivers, promote the development of new productive forces and new industries. Develop breakthrough, outstanding and competitive mechanisms and policies for international financial centers, free trade zones, and key economic zones.
Urgently amend and supplement legal documents to meet the requirements of implementing the policy of streamlining the apparatus of the political system, arranging administrative units, associated with decentralization and maximum delegation of power according to the motto "locality decides, locality does, locality is responsible" and restructuring new development space in each locality.
Develop and perfect laws on the organization and operation of judicial agencies and judicial support in accordance with the goals and orientations of judicial reform. Strongly promote the development of a legal service system, legal support, legal aid, and registration of guarantee measures to make it easier for people and businesses to access the law and manage legal risks.
Prioritize legal support resources for the private economic sector. Study the formation of public attorney regulations and a mechanism with conditions to allow civil servants to practice law, ensuring recognition and enforcement of arbitration judgments in accordance with international standards and practices.
Research to expand the scope and improve the effectiveness of applying shortened judicial procedures, combine non-competitive judicial methods with judicial procedures, have solutions to encourage and develop institutions for settling disputes outside the court such as commercial arbitration and commercial mediation.
