The Government has just issued Decree No. 157/2024/ND-CP amending and supplementing a number of articles of Decree No. 105/2015/ND-CP detailing the implementation of a number of articles of the Environmental Police Ordinance.
Accordingly, Decree No. 157/2024/ND-CP amends and supplements Clause 3, Article 6 of Decree No. 105/2015/ND-CP on the authority to request agencies, organizations, enterprises and individuals to provide information, documents and objects; request explanations of acts showing signs of crime and administrative violations of the environment, resources and food safety.
According to the new regulations, this is the authority of: Director of the Department of Police for Prevention and Control of Environmental Crimes; Director of Provincial Police; Head of the Department of Police for Investigation of Crimes on Corruption, Economy, Smuggling, and Environment of Provincial Police; Head of District Police.
At the same time, Decree No. 157/2024/ND-CP also amends and supplements Clause 2, Article 7 of Decree No. 105/2015/ND-CP on the authority to issue decisions to inspect compliance with laws on environment, resources, and food safety.
Accordingly, the Director of the Department of Environmental Crime Prevention and Control; Director of Provincial Police; Head of the Department of Investigation of Corruption, Economic, Smuggling, and Environmental Crimes of Provincial Police; Head of District Police have the authority to issue decisions to inspect compliance with laws on environment, natural resources, and food safety.
In addition, Decree No. 157/2024/ND-CP also amends Clause 2, Article 8 of Decree No. 105/2015/ND-CP on the authority to issue decisions to inspect vehicles, objects, and locations related to crimes and administrative violations related to the environment, resources, and food safety. This is the authority of the Director of the Department of Environmental Crime Prevention and Control; Director of the Provincial Public Security; Head of the Department of Investigation of Corruption, Economic, Smuggling, and Environmental Crimes of the Provincial Public Security; Head of the District Public Security.
Decree No. 157/2024/ND-CP takes effect from December 20, 2024.
