In case of retirement according to Decree 178, civil servants do not have to return allowances

Officials who have quit their jobs and received benefits under Decree 178/2024, then continue to work at another agency, will not have to return the benefits they have received.

Ms. Hoang Thi Oanh (character's name has been changed) sent a question to the Ministry of Home Affairs. She stated that in the case of public service unit officials who quit their jobs according to Decree 178/2024, when they continue to work at other agencies, organizations, and units receiving salaries from the state budget, will they have to return the allowances received according to Decree 178/2024 or not.

Regarding Ms. Oanh's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Accordingly, according to the provisions of Decree No. 178/2024, civil servants who have quit their jobs and enjoy the policy under Decree No. 178/2024, and are then allowed to work at another agency, will not have to return the allowance received.

The Ministry of Home Affairs said that the synthesis of reports from ministries, branches and localities shows that up to now, 141,444 people nationwide have had decisions to quit their jobs (an increase of 34,732 people compared to the report on September 5, 2025), of which 102,378 people (72.38%) have received payment for policies and regimes.

Previously, the Ministry of Home Affairs also issued Official Letter 1814 guiding the implementation of Decree No. 178/2024 and Decree No. 67/2025 of the Government, detailing 8 groups of beneficiaries of regimes and policies in implementing the organizational arrangement in the political system.
