10 tasks and powers of the People's Committee of communes according to the new regulations

The Lao Dong Newspaper Legal Consulting Office replied:

Article 22 of the Law on Organization of Local Government 2025 (effective from June 16, 2025) stipulates the duties and powers of the People's Committee of communes as follows:

1. Develop and submit to the People's Council at the same level for consideration the issuance of a resolution to perform the tasks and powers specified in Point a, Point b, Clause 1, Points a, b, c, d, Clause 2, Clauses 3, 4, 5, 6 and 7, Article 21 of this Law and organize the implementation of the Resolution of the People's Council at the same level.

2. Organize the implementation of the Constitution, laws, documents of superior state agencies and resolutions of People's Councils at the same level in the area; ensure conditions on facilities, human resources and other necessary resources to implement the Constitution and laws in the area.

3. Implement state administrative management in the area, ensuring a unified, smooth, continuous, effective, efficient, democratic, rule of law, professional, modern, clean, public, transparent administration, serving the people and subject to inspection and supervision by the people.

4. Decision on allocation and assignment of expenditure estimates for items that have not been allocated in detail; decision on adjustment of self- Funded budget estimates and other contents according to the provisions of law on state budget.

5. Stipulate the tasks and powers of specialized agencies and other administrative organizations under the People's Committee at their level; decide to establish, reorganize, change the name, dissolve, stipulate the organization, tasks and powers of public service units under the People's Committee at their level according to the provisions of law.

6. Management of staffing in local government administrative agencies, the number of people working with salaries from the state budget in public service units under management; manage the organization and operation of forces participating in protecting security and order at the grassroots level, non-professional workers in the area according to the provisions of law and decentralization of superior state agencies.

7. Decide according to the authority of the detailed plans of their level; implement linkages and cooperation between commune-level administrative units according to the provisions of law.

8. Issue the Working Regulations of the People's Committees at their level.

9. Issue decisions and other administrative documents on issues under its tasks and powers; abolish, amend, supplement, and replace documents issued by itself when considered no longer appropriate or illegal.

10. Perform the assigned tasks and powers, delegated authority and other tasks and powers according to the provisions of law.

Thus, the duties and powers of the People's Committee of the commune according to the new regulations as above.
