Authority to remove Chairman of the People's Committee of the commune

The Lao Dong Newspaper Legal Consulting Office replied:

Article 39 of the Law on Organization of Local Government 2025 (effective from March 1, 2025) stipulates the transfer and removal of the positions of Chairman of the People's Committee and Vice Chairman of the People's Committee as follows:

1. The Prime Minister decides to transfer the Chairman of the People's Committee, Vice Chairman of the Provincial People's Committee; Chairman of the Provincial and District People's Committees decides to transfer the Chairman of the People's Committee, Vice Chairman of the People's Committee at the direct subordinate level.

2. The Prime Minister decides to remove from the positions of Chairman of the People's Committee, Vice Chairman of the Provincial People's Committee; Chairman of the Provincial and District People's Committees decides to remove from the positions of Chairman of the People's Committee, Vice Chairman of the People's Committee at a direct level when the Chairman of the People's Committee, Vice Chairman of the People's Committee violates the law or does not properly perform the assigned duties and tasks.

3. The Chairman of the People's Committee and the Vice Chairman of the People's Committee who are transferred or dismissed from their positions shall cease their duties from the date the transfer or dismissal decision takes effect.

Thus, from March 1, 2025, the Chairman of the District People's Committee decides to remove the position of Chairman of the People's Committee at the lower level who directly violates the law or does not properly perform his assigned duties and tasks.
