11 cases of leading and managing civil servants may be dismissed from August 2026

Article 23 of Decree 300/2026/ND-CP (effective from August 1, 2026) stipulates the amendment and supplementation of Article 53 of Decree No. 170/2025/ND-CR stipulating the dismissal of leading and managing civil servants as follows:

1. The consideration of dismissal for leading and managing civil servants is carried out in the following cases:

a) Being disciplined with a warning and being assessed by competent authorities as having limited capacity, reduced prestige, unable to continue to hold the assigned position;

b) Being disciplined with a reprimand related to the responsibilities and tasks assigned 2 or more times within a term of appointment;

c) Having over 2/3 of the low confidence votes at the voting session as prescribed;

d) Having been classified as failing to complete tasks related to the performance of assigned responsibilities and tasks for 02 consecutive years;

e) Being concluded by competent authorities to have declined in political ideology, morality, lifestyle, "self-evolution", "self-transformation"; violating things that party members are not allowed to do; violating the responsibility of setting an example, causing public outrage, adversely affecting the prestige of themselves and agencies, organizations, and units where they are working;

e) Being concluded by a competent authority to violate political standards according to regulations on protecting internal Party politics to the extent of dismissal;

g) Being the head of agencies, organizations, and units under their management, directly in charge, or directly subordinates that cause corruption, waste, and negativity causing very serious consequences according to the conclusion of the competent authority but not to the extent that disciplinary action must be considered and handled according to regulations;

h) Being the head for agencies, organizations, and units under their management and direct responsibility to have serious conflicts and disunity according to the conclusions of competent authorities;

i) According to the recommendations of competent authorities;

k) Belonging to one of the cases specified in Clause 1, Article 52 of this Decree but not voluntarily resigning;

l) Other cases according to Party regulations or legal regulations.

Thus, from August 1, 2026, leading and managerial civil servants may be dismissed in cases according to the above regulations.
