Article 23 of the Trade Union Law (amended) 2024, effective from July 1, 2025, stipulates the State's responsibility towards Trade Unions as follows:
1. Ensure, support, coordinate and facilitate the Trade Union to perform its functions, tasks, rights and responsibilities in accordance with the provisions of law.
2. Propagating, disseminating and educating about laws on trade unions, labor and other legal provisions related to the rights and obligations of employees.
3. Inspect, examine, monitor and handle violations of the law on trade unions, labor and other laws directly related to the legitimate and legal rights and interests of employees; together with the Trade Union, care for and ensure the legitimate and legal rights and interests of employees.
4. Seek the opinion of the Trade Union when developing policies and laws directly related to trade unions and the rights and obligations of workers.
5. Coordinate and create conditions for the Trade Union to participate in state management, socio-economic management, represent and protect the legitimate and legal rights and interests of workers; have preferential policies for recruiting full-time trade union officials who have grown up from the grassroots level, and workers who have grown up in the workers' movement and trade union activities.
6. Timely handle the Union's recommendations related to caring for and protecting the legitimate and legal rights and interests of employees and union activities.
7. The Government, Ministries, ministerial-level agencies, and local authorities are responsible for providing necessary information and documents for Trade Unions to participate in giving opinions and social criticism in the development of policies, laws, planning, plans, programs, projects, and proposals of state agencies directly related to Trade Unions, the rights and interests of Trade Union members, and workers.
Thus, the State has the responsibility towards the Trade Union as above.
