Point d, Clause 1, Article 23 of the 2019 Law on Militia and Self-Defense Forces stipulates the appointment and dismissal of militia and self-defense forces commanders as follows: 1.
The authority to appoint the positions of Militia and Self-Defense Commanders, except for the positions of Self-Defense Commanders in military enterprises, is stipulated as follows: ...d) The Chairman of the District People's Committee decides to appoint the command positions of the Commune-level Military Command.
The Chairman of the Provincial People's Committee decides to appoint command and assistant positions of the Commune-level Military Command.
This regulation is amended by Point b, Clause 11, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) as follows:

Thus, from July 1, 2025, the Chairman of the Provincial People's Committee has the authority to decide to appoint assistants of the Commune-level Military Command.
