Article 12 of Decree 53/2026/ND-CP (effective from February 5, 2026) amends and supplements Clause 1, Article 33 of Decree 66/2021/ND-CP detailing the implementation of a number of articles of the Law on Natural Disaster Prevention and Control and the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes as follows:
People who do not receive salaries from the state budget during the time they are mobilized to perform disaster prevention and control tasks, participate in training, coaching, and drills are entitled to labor day allowances as follows:
a) The level of labor day allowance is decided by the Provincial People's Committee submitting to the People's Council of the same level, but not lower than the level specified in point a, clause 1, Article 11 of Decree No. 72/2020/ND-CP detailing a number of articles of the Law on Militia and Self-Defense Forces on organization of force building and regimes and policies for Militia and Self-Defense Forces that have been amended and supplemented in Decree No. 16/2025/ND-CP.
If training, drills and performing disaster prevention and control tasks at night (from 10 pm the previous day to 6 am the next day) are calculated to increase by no less than 50% of the current working day allowance level.
b) When training, coaching, drills, performing disaster prevention and control tasks far from residence, without daily travel and return conditions, they are arranged for accommodation, means of transportation support, travel expenses or payment for one-way train and bus fares like commune-level officials and civil servants; they are supported with meal allowances according to the level prescribed by the Chairman of the Provincial People's Committee, but not lower than the meal allowance level specified in point b, clause 1, Article 11 of Decree No. 72/2020/ND-CP detailing a number of articles of the Law on Militia and Self-Defense Forces on organization of force building and regimes and policies for Militia and Self-Defense Forces amended and supplemented in Decree No. 16/2025/ND-CP.
c) Whichever level mobilizes, that level ensures payment.
Thus, from February 5, 2026, people who do not receive salaries from the state budget who are mobilized to prevent and combat natural disasters will be subsidized as above.
