A reader with email Tranhuanxxx@gmail.com asked: How is the authority to discipline Coast Guard officers while performing official duties regulated?

The Lao Dong Newspaper Legal Consulting Office replied:

Article 22, Decree 301/2025/ND-CP (effective from November 17, 2025) stipulates the amendment and supplementation of Article 49 of Decree No. 38/2024/ND-CP as follows:

Article 49. Authority of the Coast Guard

1. Coast Guard officers on duty have the right to:

a) Fine up to 50 million VND;

b) Confiscation of exhibits and means of administrative violation with a value not exceeding 100 million VND.

2. The Head of the Coast Guard Professional Team has the right to:

a) Fine up to 100 million VND;

b) Confiscation of exhibits and means of administrative violation with a value not exceeding 200 million VND

3. The Captain of the Coast Guard Professional Team, the Chief of the Coast Guard Station has the right to:

a) Fine up to 200 million VND;

b) Confiscation of exhibits and means of administrative violation with a value not exceeding VND 400 million;

c) Apply remedial measures prescribed in Points a, c, dd and e, Clause 1, Article 28 of the Law on Handling of Administrative Violations.

Thus, from November 17, 2025, Coast Guard officers are entitled to a fine of up to 50 million VND while performing their duties.
