Salary and wages of employees when performing civil defense duties

The Lao Dong Newspaper Legal Consulting Office replied:

Article 43 of Decree 200/2025/ND-CP detailing a number of articles of the Law on Civil Defense (effective from August 23, 2025) stipulates salary, wages, meals, and special allowances for those mobilized for training, coaching, drills, and performing civil defense duties as follows:

1. People who do not receive salaries from the state budget, during the time of mobilization for training, coaching, drills, performing civil defense tasks according to the decision of the competent authority, are entitled to allowances for working days, meals and special allowances as for militia mobilized to perform tasks according to the provisions of the Decree detailing a number of articles of the Law on Militia and Self-Defense Forces on organization and construction of forces and regimes and policies for militia and self-defense forces. That level of mobilization will ensure payment.

2. The person receiving salary from the state budget during the period of mobilization for training, coaching, drills, performing civil defense duties according to the decision of the competent authority shall be paid full salary, benefits, road allowances and transportation fares by the agency or organization where the person works; when working in a toxic environment or a place with regional allowances, they shall receive according to the current regime.

Contracting employees during their time participating in training, coaching, drills, and performing civil defense duties will have their labor contracts temporarily suspended and enjoy salary and allowance regimes according to regulations.

The costs for the above items are included in the regular operating budget of the agency or unit.

3. For employees working at enterprises and organizations that do not receive salaries from the state budget, during the time of mobilization for training, coaching, drills, performing civil defense duties according to the decision of the competent authority, the mobilization agency will pay allowances for working days, meals and special allowances and other regimes as prescribed in Clause 1 of this Article; salaries paid by enterprises and organizations and will be included in production and business management costs.

Thus, from August 23, 2025, employees performing civil defense duties will receive the above salary and wages.
