The Lao Dong Newspaper Legal Consulting Office replied:
Point a, Clause 3, Article 17 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level stipulates that a person who has submitted an application to cease participating in the force participating in security and order protection at the grassroots level will be dismissed from participating in this force.
Point a, c Clause 3, Article 5, Circular 14/2024/TT-BCA stipulates:
a) For cases specified at Point a, Clause 3, Article 17 of the Law on Forces participating in the security and order protection at the grassroots level: The commune -level police shall assume the prime responsibility for receiving the resignation application for the force and within 05 working days from the date of receipt of the application, the commune -level police in collaboration with the village head, the head of the residential group, the head of the Front Task Force in the village, the residential group to take part in the reporting and the report on the reporting of the security and order for the security force to participate. The basis (Form No. 07 of the Appendix enclosed with this Circular) to report to the President of the commune -level People's Committee for consideration and decision;
c) Within 05 working days from the date of receiving a document from the commune police, the presidents of the commune -level People's Committee shall consider and decide to stop participating in the forces to participate in the security and order protection at the grassroots level (Form No. 08 of the Appendix attached to this Circular) and assign the commune police to publicize the decision at the headquarters of the People's Council, the People's Committee of the commune, the commune -level police, the communal and the communal communities, the communal police, the communal police, the communal police, the People's Committee
Thus, the dismissal of a person from participating in the security and order protection force at the grassroots level with a resignation letter is regulated as above.
