According to Mr. P.T.T (Hung Yen), Appendix I of the List of Import-prohibited goods issued with Decree No. 69/2018/ND-CP mentions "right-handed means of transport", but there is no official definition in the legal document system, causing difficulties in application.
The above Appendix also lists "specialized motorbikes" (which are not vehicles participating in regular road traffic) in the same list of banned vehicles as other types of motor vehicles, which is not appropriate.
Mr. T suggested that the authorities review and amend the regulations.
Regarding this issue, on the Government Electronic Information Portal, the Ministry of Industry and Trade has the following opinion:
Clause 1, Article 7 of the Law on Promulgation of Legal Documents No. 64/2025/QH15 stipulates: "The language used in legal documents is Vietnamese, ensuring accuracy, popularity, unity, and clear and easy-to-understand expression".
"Right-handed vehicle" or "Oversex driving" are popular and accurate phrases and have been used in many legal documents such as the Law on Road Traffic Order and Safety No. 36/2024/QH15; Decree No. 151/2024/ND-CP dated November 15, 2024 detailing a number of articles and measures to implement the Law on Road Traffic Order and Safety; Decree No. 30/2024/ND-CP dated March 7, 2024 regulating the management of road motor vehicles registered abroad, brought to Vietnam by foreigners for tourism...
Therefore, although not defined in legal documents or decrees, the use of the term "Right-handed Vehicle" is in accordance with the Law on Promulgation of Legal Documents and current administrative practice.
According to Clause 2, Article 2 of the Law on Road Traffic Order and Safety No. 36/2024/QH15: "Road vehicles are vehicles, including: Road motor vehicles (hereinafter referred to as motor vehicles), rudimentary road vehicles (hereinafter referred to as rudimentary vehicles), specialized motorbikes and similar vehicles".
Thus, specialized motorbikes are subjects that can be controlled equivalent to motorbikes and mopeds.
Building a list based on the risk of influence and the requirement of state management control, in which used specialized motorbikes also have similar risks to old motorbikes and mopeds.
