Long An province has just proposed to review and guide the promotion of professional titles for civil servants for doctors.
Regarding this content, the Ministry of Interior has informed.
According to the provisions of the Law on Civil Servants 2010, a professional title is a name that shows the qualifications and professional capacity of civil servants in each professional field (Clause 1, Article 8).
Under the assigned authority, the Ministry of Health has issued Joint Circular No. 10/2015/TTLT-BYT-BNV125 regulating codes and professional titles of doctors, preventive medicine doctors, and medical assistants.
Accordingly, this Circular clearly stipulates that these are different professional titles, with different responsibilities, tasks, standards, and conditions for each professional title and for each rank in each professional title.
According to the provisions of Clause 3 and Clause 4, Article 2 of Decree No. 115/2020/ND-CP, "Professional title rank" is the level that shows the qualifications, professional competence and skills of civil servants in each professional field; "Professional title promotion" is when a civil servant is appointed to hold a professional title at a higher rank in the same professional field.
Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP (amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP) stipulates the criteria and conditions for consideration of promotion, specifically: Meeting the requirements on minimum working time holding the next lower professional title according to the requirements of the professional title standards for consideration of promotion, except in the case of consideration of promotion of a professional title where the professional title according to regulations at the time of consideration does not have a next lower rank.
At the same time, Clause 2, Article 32 stipulates: In the case of civil servants currently ranked in a professional title rank that is no longer regulated by current law, they will be considered for promotion to a higher professional title rank next to the current professional title rank if they are working in a suitable job position and meet the standards and conditions prescribed in Clause 1 of this Article. This provision does not apply to cases where there is a change in the professional title code.
Therefore, the Ministry of Home Affairs proposes to conduct promotion consideration in accordance with the above regulations; only consider promotion to the next higher rank within the same professional title; do not consider promotion combined with consideration of transfer of professional title; when considering transfer of professional title, do not combine with salary increase.
