Vice Chairman of the People's Committee of Bac Ninh province Pham Van Thinh has just signed and issued a Decision on transferring the authority to certify transactions from the Chairman of the People's Committee at the commune level to the notary practice organization in Bac Ninh province.
The decision stipulates the transfer of the authority to certify transactions from the Chairman of the People's Committee at the commune level to notary professional organizations in Bac Ninh province, including transactions related to real estate assets; transactions related to land users' rights according to the provisions of the law on land; transactions on housing according to the provisions of the law on housing; testaments; Documents refusing to receive inheritance; Documents for dividing assets into real estate assets and land use rights according to the provisions of the law on land and housing according to the provisions of the law on housing.
Accordingly, the transfer of the authority to certify transactions from the Chairman of the People's Committee at the commune level to the organization of notary practice is carried out in the following wards and communes: Bac Giang ward, Tan Tien ward, Yen Dung ward, Viet Yen ward, Chu ward, Kinh Bac ward, Vo Cuong ward, Tu Son ward, Que Vo ward, Thuan Thanh ward, Phuong Lieu ward, Lang Giang commune, Luc Nam commune, Hiep Hoa commune, Tan Yen commune, Tien Du commune, Yen Phong commune, Gia Binh commune, Luong Tai commune.
From the effective date of the decision, the Chairman of the People's Committee of the commune where the transfer is carried out no longer has the authority to certify the above transactions.
For the remaining commune-level areas in the province that have not yet transferred the authority to certify transactions, organizations and individuals have the right to choose notaries at notary organizations in the province or the certificate of the Chairman of the People's Committee at the commune level according to regulations.
In case after the Decision takes effect, at the commune level, there is a notary practice organization that meets the transfer conditions prescribed in Decree No. 104/2025/ND-CP detailing a number of articles and measures to implement the Notary Law, the Provincial People's Committee shall assign the authority to the Department of Justice to decide on transferring the transaction certification authority from the Chairman of the People's Committee at that specific commune level to the notary practice organization.
In case there is a transfer decision but then there is no longer a notary practice organization in the commune that meets the transfer conditions prescribed in Decree No. 104/2025/ND-CP, the Chairman of the People's Committee at the commune level is responsible for continuing to certify the transaction. The Provincial People's Committee decentralizes to the Department of Justice to decide to terminate the transfer.
The Department of Justice is responsible for regularly reviewing, evaluating, and deciding to transfer the authority to certify transactions from the Chairman of the People's Committee at the specific commune level to the notary practice organization according to regulations. Timely decide to terminate the transfer in cases where the notary practice organization at the commune level no longer meets the transfer conditions according to regulations.
The Chairman of the People's Committee at the commune level is responsible for notifying the transfer of the authority to certify transactions to notary practice organizations in the locality. Notary organizations are responsible for receiving and notarizing according to legal regulations, meeting the needs of organizations and individuals. The decision takes effect from November 15, 2025.
