The 2024 Law on Social Insurance has stipulated compulsory social insurance contributions for non-specialized workers in villages and communes.
According to data from Vietnam Social Security, by the end of February 2026, there were 22,822 non-specialized workers in villages and residential groups nationwide participating in compulsory social insurance (BHXH).
However, a report on the implementation of the Law on Social Insurance after more than 1 year of operation, recently, the Ministry of Home Affairs said that the regulation on compulsory social insurance contributions for non-specialized workers in villages and communes has raised problems.
The reason is that the Law on Organization of Local Government No. 72/2025/QH15 no longer specifically stipulates non-specialized personnel at the commune, village, and residential group levels, but uses the term "non-specialized personnel receiving allowances from the state budget".
According to the Ministry of Home Affairs, the difference in regulations between the two laws may cause inconsistency in the process of applying the law. Therefore, it is necessary to amend the regulations at point k, clause 1, Article 2 of the 2024 Law on Social Insurance to ensure synchronization in the legal system.
Regarding this issue, in the draft amendment and supplement to the Law on Social Insurance, the drafting agency proposed to stipulate that one of the subjects eligible for compulsory social insurance contribution is "non-specialized workers enjoying allowances from the state budget".
The amendment is implemented based on Conclusion No. 137-KL/TW and Conclusion No. 163-KL/TW of the Politburo and the Secretariat on ending the use of non-specialized personnel at the commune level, and at the same time studying the roadmap to extend the use of non-specialized personnel in accordance with the time of completion of rearranging villages and residential groups.
Accordingly, the adjustment of regulations on subjects participating in compulsory social insurance both ensures compliance with the policy of ending the use of non-specialized personnel at the commune level, and unifies the term with the provisions of the Law on Organization of Local Government, creating favorable conditions in the implementation process.
