Permanent Vice Chairman of the City People's Committee Duong Duc Tuan has just signed and issued Plan No. 345/KH-UBND dated December 17, 2025 on handling facilities that do not meet fire prevention and fighting requirements according to Clause 6, Article 55 of the Law on Fire Prevention, Fire Fighting and Rescue No. 55/2024/QH15 and works put into operation without fire prevention and fighting acceptance in Hanoi city.
The plan aims to raise awareness and sense of responsibility of investors and heads of establishments in strictly complying with the provisions of the law on fire prevention and fighting.
Ensure progress and a roadmap for handling facilities that do not meet fire prevention and fighting requirements and are unable to recover according to technical standards and regulations at the time of operation until before the effective date of the Fire Prevention and Rescue Law and handle facilities that have not been granted a fire prevention and fighting acceptance document.
Establishments under fire prevention and fighting management according to regulations include: Establishments put into operation without being granted a fire prevention and fighting acceptance document; Establishments that do not meet fire prevention and fighting requirements and cannot overcome them according to the provisions of Clause 6, Article 55 of the Law on Fire Prevention and Fighting and Rescue. The implementation period is from now until July 1, 2028.
After July 1, 2028, the facility cannot apply or has not yet complied with the technical solutions issued by specialized construction management ministries, then the conversion of functions will be carried out in accordance with the scale and nature of the facility's operations.
The roadmap for handling facilities put into operation when they have not been granted a PCCC acceptance document:
Before January 1, 2026, classify, establish and publish a list of facilities put into operation that have not been granted a PCCC acceptance document.
Apply handling measures, specifically: Organize to invite Investors with violating works (invit relevant functional units to participate to clarify the responsibilities of each level, each industry, each locality, and units associated with each project, specific violations) to unify measures and solutions for implementation. Require the Investor to commit to a roadmap and implementation time (to be completed before March 15, 2026).
Conduct inspections and instruct investors to overcome existing problems and violations of fire prevention and fighting, in which priority should be given to handling works with high fire and explosion risks, works that can cause great damage to people and property when a fire occurs (warehouses, factories, apartment buildings, high-rise buildings, etc.).
In case the facility is put into operation without being granted a fire prevention and fighting acceptance document on the list of facilities that do not meet fire prevention and fighting requirements and cannot be remedied according to the provisions of Clause 6, Article 55 of the Law on Fire Prevention and Fighting and Rescue, the specific measures stated in this Plan will be applied.
