Lao Cai rectifies administrative violation handling work

The Chairman of Lao Cai Provincial People's Committee proposed to thoroughly overcome shortcomings and limitations in the handling of administrative violations.

On January 10, according to Lao Dong's source, the Chairman of Lao Cai Provincial People's Committee has just issued a document requesting units and localities to rectify the work of handling administrative violations.

Accordingly, in recent times, agencies, units; People's Committees at district and commune levels in Lao Cai province have detected, combated and promptly handled many administrative violations (VPHC).

In addition to the achieved results, the work of handling administrative violations still has limitations such as: Detection and handling of administrative violations are not timely and resolute; the recording of administrative violations and issuance of decisions to handle administrative violations in many cases do not comply with regulations.

In particular, there are cases of determining the wrong authority to draw up a record of administrative violations, wrong authority to impose penalties; deciding on the wrong fine level, not fully applying additional penalties, remedial measures; there are cases of transferring administrative violation penalty files to the competent authority to impose penalties not on time...

To thoroughly overcome the above-mentioned shortcomings and limitations, Chairman of Lao Cai Provincial People's Committee Trinh Xuan Truong requested departments, branches, sectors and localities to regularly inspect the law compliance of organizations and individuals in the management area to promptly detect, resolve and handle administrative violations according to regulations.

In addition, when considering a violation case to impose administrative sanctions, if it is found that the violation has signs of a crime, the competent person handling the case must immediately transfer the case file to the criminal prosecution agency according to regulations.

Heads of units shall proactively inspect the handling of administrative violations at their units and affiliated units. Promptly detect errors in administrative violation handling decisions for correction, amendment and supplementation.

Direct agencies and units to closely monitor issued decisions on administrative sanctions for violations; regularly inspect and urge the implementation of decisions on administrative sanctions for violating individuals and organizations.

Focus on close coordination between agencies, units and localities in handling administrative violations, not avoiding or shirking responsibility.

For complicated cases or cases where the competent authority is having difficulty or problems in applying the law, when preparing a penalty file, it is necessary to promptly seek opinions from the local administrative violation handling management agency and other relevant agencies for consideration and resolution according to regulations, to avoid cases of wrongly determining authority; and sanctioning acts that have expired.

Strictly and effectively implement legal regulations related to responsibility and disciplinary action in the enforcement of the law on handling administrative violations. For records with errors, it is necessary to clarify the responsibility of individuals for disciplinary action.
