On October 22, 2024, the People's Committee of Long An province issued Notice No. 3114/TB-UBND on land recovery due to land violations as prescribed in Clause 8, Article 81 of the Land Law dated January 18, 2024 of Long An Steel Company Limited in Long Hiep commune, Ben Luc district, Long An province.
Accordingly, the People's Committee of Long An province announced the land recovery of Long An Steel Company Limited (headquarter address: 25/1 National Highway 1A, Long Hiep commune, Ben Luc district, Long An province). The recovered land area is more than 49,000 m² including: More than 22,649 m² of land belonging to the Steel Billet and Steel Rolling Factory Project and 26,353 m2 of land belonging to the Steel Billet and Steel Rolling Factory Expansion Project. This area belongs to land plots No. 243, 260, 234, map sheet No. 03, in Long Hiep commune, Ben Luc district.
According to the People's Committee of Long An province, the reason for land recovery was previously inspected by the Department of Natural Resources and Environment and issued Conclusion No. 1486/KL-STNMT dated November 11, 2019. Accordingly, Long An Steel Company Limited was 24 months behind schedule recorded in the investment project, so it was granted a 24-month extension of land use and had to pay the State an amount of money equivalent to the land use fee and land rent for the period of delay in project implementation as prescribed in Point i, Clause 1, Article 64 of the 2013 Land Law (now Clause 8, Article 81 of the Land Law dated January 18, 2024). However, up to now, this company has not completed the procedures to extend the land use schedule.
The People's Committee of Long An province assigned the Department of Natural Resources and Environment to carry out procedures to reclaim land from Long An Steel Company Limited in accordance with current legal regulations. The People's Committee of Ben Luc district was assigned to send a notice of land reclamation to Long An Steel Company Limited; and the Department of Natural Resources and Environment was assigned to coordinate with the People's Committee of Long Hiep commune to determine specific boundary markers on the field.
Long An Steel Company Limited is responsible for handling the assets on the land no later than 45 days from the date of receipt of this notice.
Previously, in June 2003, the Long An Provincial People's Committee issued a document approving the location for Long An Steel Company to expand its factory. However, many years have passed, but the project has not been implemented. This is one of the delayed and prolonged projects subject to inspection and review by the Provincial People's Committee in Plan 1860/KH-UBND, dated June 30, 2023.
Also related to the Steel Billet and Rolling Mill Project and the Steel Billet and Rolling Mill Expansion Project of Long An Steel Company Limited, on August 1, 2023, the Department of Planning and Investment presided over and coordinated with representatives of the Inspection Team to conduct a field inspection.
After the inspection, the sectors and localities met and agreed to implement the content of the request for the Department of Natural Resources and Environment to consider and handle land recovery due to the company's delay in putting the land into use according to the provisions of the 2013 Land Law.
The sectors also agreed that after the Department of Natural Resources and Environment handles the land recovery for the above project, the Department of Planning and Investment will report to the Provincial People's Committee to handle the project according to the law (including the termination of project activities). Issues arising after land recovery, project recovery (accepting investment at the above land location, arranging resettlement for the remaining households) will be implemented by the sectors and localities according to the provisions of current law.
