Reasons for not yet completing site clearance for a project worth over VND1,800 billion in Dak Lak

Dak Lak - The authorities have not been able to complete the clearance of 113m of the urban bypass project worth more than VND1,800 billion because many households have not agreed to the compensation plan.

Not yet found a common voice

Regarding the Ho Chi Minh Road Project, the eastern bypass section through Buon Ma Thuot city (Dak Lak), the Ministry of Construction has issued a deadline for requesting Dak Lak province to resolve land problems before May 30, 2025.

Otherwise, the Ministry of Construction will consider the project zoning plan and hand over the unfinished part to the locality for self-management.

Actual records show that there are still 113m of the route passing through Cu M'gar district with 16 households affected. In particular, most people have not agreed with the proposed compensation level.

Mr. Nguyen Van Dung (residing in Ko Hneh hamlet, Cuor Dang commune, Cu M'gar district) said that I am willing to relocate but the compensation plan must be appropriate.

Mr. Dung's land plot has an area of 185m2 of residential land, granted a Land Use Rights Certificate since 2001. The Certificate does not include any notes on the planning of the traffic safety corridor.

In 2022, the Land Fund Development Center of Cu M'gar district drafted a compensation plan. Accordingly, the land area for which Mr. Dung's family was compensated was 141.2/185m2. The remaining area is believed to be a traffic safety corridor and will not be compensated. The compensation price for each square meter of residential land is VND 29.450 million.

After drafting the plan, the Land Fund Development Center of Cu M'gar district did not make further moves. It was not until 2024 that they restarted compensation. Accordingly, the area compensated by Mr. Dung's family suddenly decreased from 141.2m2 to 24.9m2.

The compensation price for land also decreased from VND 29,450,000/m2 ( VND valued in 2022) to VND 23,500,000/m2. Therefore, the expected compensation for Mr. Dung decreased from VND4.9 billion in 2022 to more than VND827 million in 2024.

Similarly, Mr. Le Van Bang (residing in Ko Hneh hamlet, Cuor Dang commune) has not yet agreed with the draft compensation plan.

Mr. Bang has a plot of land with two road frontages of 200m2 (higher compensation coefficient). Of which, Mr. Bang's residential land alone has an area of 75m2. In 2022, the draft compensation price is 44,730,000 VND/m2. However, by 2025, the land compensation price will decrease to VND 27,048,000/m2.

Thus, his family's compensation was reduced from 4.7 billion VND to 2.4 billion VND. While surrounding households have been compensated and received compensation according to the price of 2022.

Many difficulties and problems have not been resolved

Mr. Nguyen Cong Van, Vice Chairman of the People's Committee of Cu M'gar district, said that the site clearance work is behind schedule due to many difficulties.

According to Mr. Van, the Land Use Rights Certificate was previously issued according to a paper diagram. Currently, the issuance of Land Use Rights Certificates based on digital maps has led to incorrect results.

Some Land Use Rights Certificates do not show traffic safety corridor planning but now they must be deducted according to regulations.

In addition, many cases of building houses outside traffic corridors have occurred for a long time but the authorities have not promptly handled them.

Mr. Nguyen Cong Van - Vice Chairman of Cu M'gar District People's Committee said that many households have not agreed with the draft site clearance plan. Because with the proposed draft plan, many households have lost almost all their assets and houses.

The People's Committee of Cu M'gar district has proposed that the People's Committee of Dak Lak province consider and remove difficulties so that people can soon stabilize their lives.

The Ho Chi Minh Road construction investment project, the eastern bypass of Buon Ma Thuot city, is nearly 40km long, with a total investment of more than VND1,800 billion.

According to the plan, the project must be completed by the end of 2024. However, due to land clearance problems, the project has not yet been completed and has been extended to June 30, 2025.
