Banned from bidding for 3 years
On July 31, the National Bidding Network posted information on bidding sanctions from the People's Committee of Thanh Hoa province.
Accordingly, Mr. Dau Thanh Tung, Vice Chairman of Thanh Hoa Provincial People's Committee signed a decision to ban Vietnam Construction Joint Stock Company from participating in bidding activities (Enterprise code: 0105663540).
The decision clearly states that Vietnam Construction Joint Stock Company will be banned for 3 years (from the date of signing the decision on July 29, 2025). The scope of ban on participating in bidding activities is for projects and bidding packages using budget capital invested by provincial-level agencies, departments, branches and People's Committees of communes and wards in Thanh Hoa province/call for bidding.
The reason this company was banned from bidding is because it forged documents in the bidding documents of package No. 05 - Construction of works under the Thach Thanh 4 High School facilities upgrade project; violating the provisions of Point a, Clause 4, Article 16 of the 2023 Bidding Law.
Legal basis for handling violations: According to the provisions of Article 87 of the Law on Bidding and at Point a, Clause 1, Article 125 of Decree No. 24/2024/ND-CP dated February 27, 2024 of the Government.
The People's Committee of Thanh Hoa province assigned the Thach Thanh Construction Investment Project Management Board (Investor) to be fully responsible before the law and the Chairman of the Provincial People's Committee for the accuracy, reporting content, and proposals on handling violations by the above contractor according to regulations.
Revealing detailed reasons for the ban on bidding
It is known that previously, on April 4, 2025, Mr. Nguyen Duc Luan, then Director of the Thach Thanh District Construction Investment Project Management Board (old) signed Decision No. KQ2500034324_2504030808 on approving the results of online contractor selection of Package No. 5.
According to the Decision, the winning bidder was the Joint Venture of Thach Thanh 4 High School (this consortium includes 2 companies, Toan Cau Construction and Consulting Joint Stock Company and Truong Thinh Construction Investment and Trading Consulting Company Limited).
The 2 units that did not win the bid were Vietnam Construction Joint Stock Company (the company has just been banned from bidding). The reason for this company's failure to bid is due to the content of Contract No. 02/HDNT-VNPC on testing construction materials between Vietnam Construction Construction Joint Stock Company and Viet Trung Investment and Trading Consulting Joint Stock Company, which is a fake document violating the provisions of Point a, Clause 4, Article 16 of the Bidding Law No. 22/2023/QH15 dated June 23, 2023.
Another unit that did not win the bid was Truong Son Irrigation Construction Company Limited. The reason this unit did not win the bid is that the contractor did not have a complete plan for the construction site (E-HSDT only had the camp site not including all items as required). Therefore, it does not meet the requirements of E-HSMT, should be assessed as not meeting the technical requirements and not being assessed for further steps.
Another noteworthy piece of information is that the winning bidder was the company that had offered the highest bid.
It is known that previously, the Joint Venture of Thach Thanh 4 High School (a consortium of 2 companies, Toan Cau Construction and Consulting Joint Stock Company and Truong Thinh Construction Investment and Trading Consulting Company Limited) abandoned the bidding price after the discount of VND 30,256,887,985.8331 (more than VND 20 million lower than the bidding package price).
As for Vietnam Construction Joint Stock Company, the bid price after the discount is VND 28,524,372,062.1422 (lower than the bid package price by more than VND 1.75 billion)
Truong Son Irrigation Construction Company Limited has a bid price after a discount of VND 28,686,940,669.7358 (less than the package price by nearly VND 1.6 billion).
Information about package No. 5: Construction of works under the Thach Thanh 4 High School Facilities Repair and Upgrade Project. The approved package price is 30,277,063,000 VND. Investor's name: Thach Thanh District Investment and Construction Project Management Board (old). Contractor selection method: Open bidding. Contract type: fixed unit price. Package implementation period: 540 days.
