According to Article 13 of the 2015 Veterinary Law, the act of throwing sick, dead animals and their products into the environment is a prohibited act. identifying dead animals, especially due to epidemics, if not treated properly, it will become a dangerous source of infection, affecting other livestock households and public health" - lawyer Ha analyzed.
Regarding administrative sanctions, according to Decree 90/2017/ND-CP, individuals who commit this act can be fined from 5 - 6 million VND, and organizations that violate the law can be fined twice. Article 241 of the 2015 Penal Code (amended and supplemented in 2017) stipulates: If the act of spreading dangerous diseases to animals leads to serious consequences such as causing economic damage and causing death, the violator may be imprisoned for up to 12 years.
According to lawyer Hoang Van Ha, in some cases, although local authorities have organized the destruction of dead pigs, if they do not follow the correct technical procedures such as not treating chemicals, letting the burial holes leak fluid, causing environmental pollution, spreading epidemics, the implementing unit or related leaders can be administratively or criminally prosecuted.
According to the Law on Environmental Protection 2020 and Decree 45/2022/ND-CP, the act of destroying dead animals that do not comply with standards, causing environmental pollution, can be subject to administrative sanctions or criminal prosecution under Article 235, Article 236 of the 2015 Penal Code (Crime of causing environmental pollution or violating regulations on handling hazardous waste).
If there are signs of irresponsibility causing serious consequences, cadres and civil servants can also be handled according to Article 360 of the 2015 Penal Code.
