On the Government Portal, Mr. H.Q (Hanoi) said that he had just bought a SH motorbike registered in 2024. Mr. Q asked, what documents are required to change the ownership?
Regarding this issue, the Ministry of Public Security responded as follows:
Article 16, Article 17 of Circular No. 79/2024/TT-BCA dated November 15, 2024 of the Minister of Public Security regulating the issuance and revocation of vehicle registration certificates, license plates of motor vehicles and specialized motorbikes has specifically stipulated the responsibilities of vehicle owners, records and procedures for name change, and requested Mr. Q to comply with regulations.
It is known that Articles 16 and 17 of Circular No. 79/2024/TT-BCA stipulate as follows:
Article 16. Vehicle registration file
1. Revokation dossier
a) Declaration of revocation of vehicle registration certificate, license plate;
b) Documents of the vehicle owner as prescribed in Article 10 of this Circular;
c) 02 copy of the engine number and chassis number of the vehicle. ;
d) Photocopy of vehicle ownership transfer documents as prescribed;
d) Vehicle registration certificate, license plate; in case of loss of vehicle registration certificate or license plate, the reason must be clearly stated in the declaration of revocation of vehicle registration certificate, license plate.
While waiting for the revocation results, the vehicle owner is allowed to keep the license plate for use and must return it upon receiving the revocation certificate; in case the vehicle owner does not return the license plate, the vehicle registration agency will cancel the results and request the vehicle owner to re-do the revocation procedures in case of loss of the license plate according to regulations.
2. Registration documents
a) Vehicle registration declaration;
b) Documents of the vehicle owner as prescribed;
c) Vehicle ownership transfer documents according to regulations;
d) Vehicle registration fee documents as prescribed;
d) Certificate of revocation of vehicle registration certificate, license plate.
Article 17. Vehicle registration procedures
1. Revokation procedures
a) The vehicle owner declares the declaration of revocation of vehicle registration certificate and license plate on the public service portal, provides an online vehicle registration file code or declares the declaration of revocation of vehicle registration certificate and license plate (according to the DKX11 form issued with this Circular) to the vehicle registration agency; submit the revocation file as prescribed in Clause 1, Article 16 of this Circular and receive an appointment to return the results of the vehicle registration certificate and license plate revocation certificate as prescribed;
b) After checking valid vehicle records, the vehicle registration agency shall issue 02 certificates of revocation of vehicle registration certificate and license plate according to regulations with copy of the engine number, chassis number and stamp of the vehicle registration agency on the copy of the engine number and chassis number (01 copy returned to the vehicle owner, 01 copy of vehicle records). For temporarily imported and re-exported vehicles of subjects entitled to diplomatic immunity, 03 certificates of revocation of vehicle registration certificates and license plates (02 returns to vehicle owners to submit to the customs authority and vehicle registration agency, 01 copy of vehicle records) are issued.
In case the vehicle owner has a need, a temporary vehicle registration certificate will be issued along with a certificate of revocation of the vehicle registration certificate and license plate, without having to have a temporary vehicle registration file.
2. Registration procedures
a) Organizations and individuals receiving vehicle ownership transfer must declare vehicle registration certificates according to the provisions of Article 9 of this Circular; bring the vehicle for inspection and submit the dossier according to the provisions of Clause 2, Article 16 of this Circular;
b) After checking the vehicle documents, if the vehicle is actually valid, the vehicle registration agency shall issue a vehicle registration certificate and license plate according to the provisions of Point b, Clause 2, Article 14 of this Circular;
c) Receive an appointment letter to return the results, pay the vehicle registration fee and receive the license plate (in case of being issued a license plate according to the provisions of Point c, Clause 2, Article 14 of this Circular); in case the vehicle owner needs to receive the vehicle registration results via the public postal service, register with the public postal service unit;
d) Receive the vehicle registration certificate at the vehicle registration agency or from the public postal service unit.
In case the issued license plate is a 3-digit or 4-digit license plate, it must be changed to an identification license plate according to the provisions of this Circular.
