The Ministry of Transport is drafting a Decree regulating the conditions for business of motor vehicle inspection services; organization and operation of technical safety and environmental protection inspection of motor vehicles and specialized motorbikes; and the life span of motor vehicles. The draft will take effect from January 1, 2025.
Article 3 of the draft explains some terms. In particular, the inspection facility is a public service unit, enterprise or cooperative established under the provisions of law, providing public services to conduct inspection and issue inspection certificates: Motor vehicles, specialized motorbikes, exhaust emissions of motorbikes, and motorbikes (motorbikes).
Motor vehicle inspection facility is an organization that is granted a certificate of eligibility to conduct motor vehicle inspection activities to conduct inspections for motor vehicles, specialized motorbikes, and motorbike exhaust emissions inspections.
In which, the motorcycle and motorbike emission inspection facility (hereinafter referred to as the emission inspection facility) is an organization that is granted a certificate of eligibility to conduct motorcycle and motorbike emission inspection activities, conducts emission inspection and issues environmental protection certificates for motorcycles and motorbikes.
According to the draft, the conditions for emission testing facilities are as follows:
Operating principle
Only organizations that have been granted a Certificate of eligibility to conduct motorcycle and motorbike emission inspection are allowed to conduct motorcycle and motorbike emission inspection.
Inspection activities must ensure independence, objectivity, transparency and compliance with legal regulations.
For mobile emission testing facilities, it is necessary to ensure that testing activities are convenient, safe, and do not obstruct traffic.
General conditions
Emission inspection facilities must meet the requirements on facilities and human resources as prescribed in this Decree and the National Technical Regulation on technical facilities and location of motor vehicle inspection facilities; and emission inspection facilities for motorbikes and mopeds.
Facilities
The area for inspection of motorcycle and motorbike emissions must ensure adequate equipment for inspection of emissions, convenient for inspection of emissions, and not affect the normal operation of other activities.
Emission testing equipment must comply with national technical regulations on technical facilities and locations of motor vehicle inspection facilities; motorcycle and motorbike emission testing facilities and must comply with legal regulations on measurement.
Human resource conditions
The person signing the emission inspection certificate is the leader of the emission inspection facility or the person assigned by the emission inspection facility according to the provisions of law.
Emission inspection facilities must have at least 01 inspector with a minimum professional qualification of graduating from technical secondary school, trained and granted an inspector certificate according to regulations of the Minister of Transport and responsible for the inspection results.
