The Ministry of Transport is submitting to the Government a draft Decree regulating driver training and testing activities. The draft will take effect from 2025.
Regarding the need to issue a new Decree, the Ministry of Transport said that in the process of implementing Decree No. 65/2016/ND-CP on driver training and testing activities, there are still some problems such as regulations requiring conditions for driving practice grounds.
At point b and point e, clause 3, Article 6, the conditions of driving practice grounds are regulated as follows:
Car driving training facilities with a training capacity of 1,000 students or more must have at least 2 driving practice grounds according to regulations.
Minimum area of driving practice ground: Class B1 and B2 is 8,000m2; Class B1, B2 and C is 10,000m2; Class B1, B2, C, D, E and F is 14,000m2.
In practice, the number of driving practice vehicles on the driving practice ground at one time (calculating training volume) is a maximum of 80 class B vehicles, equivalent to a volume of 400 students.
However, in the past, many driving training facilities invested in driving practice vehicles and hired driving instructors who met the required conditions according to regulations to train drivers with a traffic volume of over 2,000 students, but did not invest in driving practice grounds to meet the corresponding training volume because the regulations on driving practice ground conditions for driving training facilities with a traffic volume of over 1,000 students are only quantitative, making it difficult to manage the above activities.
Therefore, to ensure clarity and transparency in training activities, it is necessary to specify the driving practice ground conditions that must be met for each training volume unit (500 students), avoiding the "circumvention of the law" that has occurred in the recent past.
In the third draft, the Ministry of Transport stipulates driving practice grounds as follows:
Under the legal use of the driving training facility; in case the training facility has a driving test service, based on the time of using the testing yard for testing purposes, it is allowed to use the testing yard to both conduct driving tests and train drivers, but only a maximum of 1 driving practice yard is allowed to be used to calculate the training volume.
Car driving training facilities arrange the number of driving practice grounds suitable to the traffic volume and training program; the number of driving practice grounds is calculated according to the traffic volume of students; determined according to the principle that 1 car driving practice ground can accommodate a maximum traffic volume of 1,000 students.
The car driving practice ground must have a complete system of road signs, sufficient situations for lessons according to the training program; the size of the driving practice shapes must comply with the National Technical Regulations on road motor vehicle driving test centers for each corresponding vehicle class.
The pitch must have a level surface and drainage system that ensures no flooding; the surface of the lanes and driving practice areas must be paved with asphalt or cement concrete, with sufficient road markings; the car driving practice areas according to the National Technical Regulations on Road Motor Vehicle Driving Test Centers must be curbed.
There is a waiting room and seats for students to practice.
Minimum area of driving practice ground: Class B is 8,000m2; Class B and C1, C is 10,000m2; Class B, C1, C, D2, D1, D, BE, C1E, CE, D2E, D1E, DE is 14,000m2.
