Strengthening inspection of compliance with regulations on cosmetic management
To continue to strengthen cosmetic management, the Drug Administration of Vietnam requests the Department of Health of provinces and centrally run cities to urgently implement the contents of the above documents and strengthen cosmetic management of cosmetic products.
Continue to strengthen the implementation of inspection and examination of the implementation of legal regulations on cosmetic management for cosmetic production and trading enterprises in the area.
Focus on inspecting and supervising the implementation of the notice of recall of cosmetics according to regulations, the production and trading of cosmetics are not at the correct announced address, the enterprise changes the business address without reporting to the management agency;
Regularly and proactively coordinate closely with the local Steering Committee 389, the Market Management Department and relevant functional agencies in the area to strengthen the inspection and examination of cosmetics circulating on the market.
In particular, focusing on inspecting cosmetic business activities on e-commerce trading floors and social networking platforms TikTok, Zalo, Facebook, YouTube... to promptly detect and handle illegal production and business activities of cosmetics, cosmetics suspected of being fake, cosmetics circulating that have not been granted a receipt number for declarations, cosmetics of unknown origin; advertising cosmetics with features and uses that exceed the original features and nature of the product, not suitable for the features and uses of the advertised product or causing misunderstanding that the product is a drug.
Strictly handle and punish organizations and individuals who violate the production and trading of cosmetics according to regulations.
Recall and destroy all types of cosmetics suspected of being fake, cosmetics of unknown origin, cosmetics that are not of good quality and are unsafe for consumers.
Transfer the file to the investigation agency for criminal handling according to regulations in cases of signs of crime (large value of goods, causing serious consequences, organized violations, recidivism...).
No production or processing of cosmetics at facilities that have not been granted a certificate of eligibility for production
For production and trading establishments, responsible for bringing products to the market, and import-export establishments, the Drug Administration requires proper implementation of regulations on cosmetic management, specifically:
Seriously research prescribed in Circular No. 06/2011/TT -BYT dated January 25, 2011 of the Ministry of Health stipulating cosmetic management to declare and update changes for the published information in accordance with the announcement card to ensure accuracy and honesty, keep the product information file (Product information file - PIF) When required;
Do not produce or process cosmetics at domestic cosmetic production facilities that have not been granted a certificate of eligibility for cosmetic production; produce formula cosmetics with ingredients in accordance with the published documents and regulations;
It is only allowed to put cosmetics into circulation when the competent state management agency has issued a receipt number for the cosmetic product declaration form and must be fully responsible for the safety, quality and effectiveness of the product.
The Department of Drug Administration (Ministry of Health) implements the instructions of the Prime Minister and the Ministry of Health in Official Dispatch No. 55/CD-TTg dated May 2, 2025 on strengthening coordination and strictly handling organizations and individuals related to the production and trading of fake medicine, fake milk and fake health protection foods;
Official dispatch No. 65/CD-TTg dated May 15, 2025 on launching a peak period of fighting against and repelling smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights; Directive No. 13/CT-TTg dated May 17, 2025 on strengthening the fight against smuggling, trade fraud and counterfeit goods in the new situation, in recent times, the Ministry of Health (Department of Drug Administration) has issued a number of directives on these issues.
Most recently, Official Letter No. 3005/BYT-QLD dated 17.5.2025 of the Ministry of Health on the deployment of public electricity No. 65/CD-TTg of May 15, 2025 of the Prime Minister; Official Letter No. 2965/BYT-QLD of May 16, 2025 of the Ministry of Health on strengthening inspection, post-commerce inspection, anti-smuggling, trade fraud, manufacturing and trading of fake and poor quality goods belonging to the group of cosmetics; Previously, Official Letter No. 1149/QLD-MP of April 23, 2025 of the Drug Administration of Vietnam on strengthening the management of cosmetics, to ensure the safety and interests of consumers, improve the effectiveness of cosmetic post-commercial inspection.
