Citizens should send questions to the Ministry of Agriculture and Environment asking about the process of completing the dossier for granting a Certificate for cases where there was a plan to increase the plot of land and change plots and had been approved by the competent authority, but at the time of land allocation, the people had not completed the dossier for granting a Certificate. Up to now, people have not been granted or re-issued the Certificate.
Responding to this content, the Ministry of Agriculture and Environment said: The reflection content is a specific case under the authority of the locality and needs to be based on archival records and specific regulations issued by the locality according to its authority to implement the Land Law for consideration and resolution; therefore, the ministry has no basis to respond.
The Ministry would like to point out some principles as follows:
The current land law has specifically regulated the issuance of Certificates of land use rights and ownership of assets attached to land in cases where there are plans and approved by competent authorities according to the provisions of Clause 4, Article 77 of Decree 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law (amended and supplemented in Clause 12, Article 4 of Decree 226/2025/ND-CP dated August 15, 2025).
Accordingly, the competent land management agency shall submit to the competent authority or person to sign and issue a Certificate on the basis of the land use plan; issue a Certificate to the granted person; transfer a set of documents with the previously issued Certificate (if any) and a copy of the issued Certificate to the Land Registration Office or a branch of the Land Registration Office to prepare and update cadastral records and land database.
