The Department of Justice of Lang Son province recommends that the regulation of subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of the Housing Law 2023 "must not enjoy housing support policies in any form in provinces and centrally run cities where there are social housing construction investment projects" is unclear, has many different understandings and is unreasonable, impassable, causing difficulties in applying and implementing the law.
The Lang Son Department of Justice proposes clearer instructions and specific regulations to have a basis for implementation to ensure compliance with regulations.
After studying, the Ministry of Construction commented as follows:
Caring for housing solutions for people has always been of interest to the Party and the State and has been identified as a key task in the socio-economic development of the country. In recent times, the State has issued many policies to support housing for policy beneficiaries such as: Supporting people with revolutionary contributions to housing according to Decision No. 22/2013/QD-TTg dated April 26, 2013 of the Prime Minister, supporting housing for poor households according to poverty standards for the period 2011-2015 according to Decision No. 33/2015/QD-TTg dated August 10, 2015 of the Prime Minister; supporting poor households to build houses to prevent storms and floods in the Central region according to Decision No. 48/2014/QD-TTg dated August 28, 2014 of the Prime Minister; supporting the purchase of old houses belonging to public assets exempted from land use fees and housing fees according to Decree No. 95/2024/NDCP dated July 24, 2024 of the Government detailing a number of articles of the Housing Law; supporting 12 groups of people when renting houses to buy houses to prevent storms and floods in the Central region according to Decree No. 100/2014/QD-TTg dated July 26, 2024 of the Government and regulations on the development of social housing and housing.
Regarding the regulations on housing conditions to enjoy social housing support policies in Point a, Clause 1, Article 78 of the 2023 Housing Law: " Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law to be able to buy or rent social housing must not have a house of their own in the province or centrally run city where there is a social housing construction investment project, have not been able to buy or rent-purchase social housing, and have not enjoyed housing support policies in any form in the province or centrally run city where there is a social housing construction investment project...".
According to the Ministry of Construction, this regulation aims to ensure the correct implementation of the principle of supporting social housing (each subject is only allowed to buy, rent, or lease-purchase 1 social housing unit/house for the number of people's armed forces; households with many subjects entitled to many support policies will only apply one support policy for the whole household), while at the same time, properly and fully meeting the housing needs of groups of policy beneficiaries in a fair and equal manner in the context of limited State resources.
The Ministry of Construction received the proposal of the Department of Justice of Lang Son province in the process of reviewing and amending the provisions of the law on housing.
