On the Government Portal, Ms. N.T.H said that she is single, with an actual monthly income of 11 million VND. In January alone, every year, she receives an additional Tet bonus of 40 million VND. Ms. H asked, considering the income criteria alone, can you buy social housing or not? She fully meets all other conditions.
Regarding this issue, the Ministry of Construction responded as follows:
Clause 1, Article 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates income conditions as follows:
"For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, it is necessary to ensure the following income conditions:
In case the petitioner is a single person, the actual monthly income must not exceed 15 million VND as calculated in the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works. In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total monthly income shall receive no more than 30 million VND in salary according to the Salary Table, confirmed by the agency, unit, or enterprise where the subject works.
The time to determine income conditions is for 01 consecutive year, starting from the time the subject specified in this clause submits a valid dossier to the investor to register to buy or rent-purchase social housing".
Based on the above provisions, the condition for income to buy social housing is that the actual monthly income received is not more than 15 million VND for single petitioners and not more than 30 million VND for married petitioners according to the provisions of law, calculated according to the salary table, salary for 1 consecutive year from the time the person in need submits the application for social housing purchase to the investor.
