The Land Management Department has opinions on people converting land use purposes to residential land at high costs.

At a regular press conference organized by the Ministry of Agriculture and Environment on September 4, Mr. Mai Van Phan - Deputy Director of the Department of Land Management answered reporters' questions about land prices and land use costs.

The Deputy Director of the Department of Land Management said that previously, according to the Land Law, there were two types of land prices including specific land prices and land price lists, applied in cases of lease or change of land use purpose. However, during the implementation process, some problems arose for households and individuals when changing land use purposes, the cost is often very high.

Mr. Phan said that for people converting to residential land at high costs, the Government has assigned the Ministry of Finance to preside over the development of a resolution to remove practical obstacles, in this draft to study and resolve the best solutions for people when there is a real need to convert existing land use purposes to residential land. The draft Resolution has a distinction that within the recognized limit, there is no need to pay; in addition to the limit, it will be calculated to correspond to each time, possibly not less than 30%, some types not less than 50%. Currently, the Ministry of Finance is receiving comments to complete and submit to the Government for promulgation.

Regarding the difficulty of low-income people accessing housing, according to Mr. Phan, this issue continues to be under the responsibility of the Ministry of Construction, the Government has also had policies related to social housing. Conditions and criteria for low-income people to be one of the subjects accessing housing.

Regarding land prices, according to Mr. Phan, policies need to ensure harmony between people whose land is recovered and people whose land has changed purpose, and at the same time ensure revenue from the state budget. However, during the implementation process, Resolution 69 has recently issued an orientation, if land use fees are large, investment attraction will be reduced. In this draft amendment to the Land Law, it will aim to use a land price list but apply in specific cases, and apply according to coefficients.

"For example, for compensation, applying a land price list but receiving coefficient to ensure promoting the disbursement of public investment capital for projects using land but also applicable to cases of changing land use purposes. Ensuring humanity and reducing investment and production costs for investors" - Mr. Phan analyzed.

34 civil servants support localities in handling land procedures

In early August, the Ministry of Agriculture and Environment sent 34 civil servants to localities to support the implementation of tasks in the land sector when implementing the two-level local government model.

Mr. Mai Van Phan said that working groups deployed by the Ministry and supported localities have assessed the implementation situation and initially recorded some results. However, the report shows that there are some notable issues. That is the limited resources for implementation, especially after the merger of administrative units. Many communes are assigned additional tasks but the resources related to cadres, skills, and professional qualifications in land management are very limited, while the tasks are assigned a lot.

Second, when merging some localities and not issuing internal and specific settlement procedures, it is difficult to clearly define the responsibilities of each agency and department in implementing tasks.

In digital transformation, some localities have not completed the construction of land databases connected to public service systems, causing difficulties in the implementation process. Many localities have a lot of work but still have to do "half rice, half electricity" which increases the time to handle procedures.
