The Ministry of Construction is drafting a specific mechanism for the North-South high-speed railway project, including a compensation, support and resettlement policy.

The Ministry of Construction is sending to the Ministry of Justice for appraisal of the draft Resolution of the National Assembly on a number of specific mechanisms and policies, especially applied to the high-speed railway project on the North-South axis (project).

According to the Ministry of Construction, because the project is still implementing investment in the form of public investment, and has not yet converted the investment form from public investment to business investment or investment under the public-private partnership or mixed-use investment method, the above design content aims to ensure the comprehensiveness of the draft Resolution, which is a general regulation of specific mechanisms and policies, especially applied to the project to invest in one of the forms of public investment, PPP investment, private investment and mixed-use investment of the above-mentioned forms of investment.

In case the Government chooses any form of investment, the corresponding provisions in the draft Resolution will apply.

One of the main contents of the draft is compensation, support, resettlement and relocation of power projects.

This is a general content applied to investment forms and inherited policies on compensation, support, resettlement and relocation of power works approved by the National Assembly in Resolution No. 172/2024/QH15 dated November 30, 2024 of the National Assembly.

Firstly, the compensation, support, resettlement and relocation of power projects will be separated into independent projects to create initiative for localities and Vietnam Electricity Group to implement.

In the case of PPP investment and business investment, this option has the advantage of that compensation, support, resettlement and relocation of power works will be implemented independently, implemented in parallel with the work of preparing the Feasibility Study Report, so it will be possible to speed up the implementation progress; in the case of localities that need to adjust the independent site clearance project, they will proactively implement it without depending on the North - South high-speed railway project, so the procedures and order will be reduced according to the viewpoint of "locality decides, locality takes responsibility".

Second, in case the central budget has not been allocated in time, localities should proactively balance local budget sources for implementation, the central budget will return to the local budget after balancing capital.

According to the provisions of the Land Law, compensation, support and resettlement costs are taken from the project. For the North-South high-speed railway project, according to the Railway Law, it is a national railway project, so the allocation of compensation, support and resettlement capital is the responsibility of the central budget.
