The Ministry of Agriculture and Environment has just issued Decision 2304/QD-BNNMT on the announcement of administrative procedures in the field of land under the state management functions of the Ministry of Agriculture and Environment.
The decision stipulates the registration and issuance of Certificates for cases of land use rights transferred before August 1, 2024 but the transferor has been granted a Certificate but has not yet carried out the procedures for transferring rights according to regulations.
How to do it:
a) Submit directly to the Public Administration Service Center or the Land Registration Office.
b) Submit via postal service.
c) Submit online on the Public Service Portal.
d) Submit at the location agreed upon between the registration ung dungctor and the Land Registration Office, Branch of the Land Registration Office.
Components and quantity of documents:
The dossier includes:
a) In case the person using the land is receiving the transfer of land use rights before August 1, 2024 but only has a contract or document on the transfer of land use rights established according to regulations and the transferor does not hand over the Certificate to the transferee, the dossier includes:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- Contracts and documents on transferring land use rights have been established according to regulations.
b) In case the transferee of land use rights only has a Certificate issued by the transferee but does not have a contract or document on the transfer of land use rights as prescribed, the dossier includes:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- Original Certificate of Land Use Rights.
- Documents on the transfer of land use rights with full signatures of the transferor and the transferee.
Number of documents: 01 set.
Processing time: No more than 08 working days.
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation period shall not exceed 18 working days.
