The Ho Chi Minh City Department of Construction said that it has received opinions from individuals and organizations about not receiving and resolving applications for construction permits for individual houses under the authority of the People's Committees of communes, wards and Con Dao special zone in Ho Chi Minh City.
Through review, the Ho Chi Minh City Department of Construction said that some communes and wards are currently based on general plans, zoning plans, old architectural management regulations (expired), and construction planning standards to issue construction permits.
Meanwhile, some wards and communes have temporarily stopped receiving dossiers due to the lack of detailed planning or approved architectural management regulations, so there is no basis for issuing construction permits according to the provisions of Article 93 of the 2014 Construction Law (amended and supplemented in Law No. 62/2020/QH14 and point I, clause 1, Article 57 of the 2024 Urban and Rural Planning Law) and related legal regulations.
According to the Department of Construction, the failure to receive and resolve applications for individual house construction permits under the authority of the People's Committees of wards, communes and the Con Dao special zone mainly falls into the following areas:
The area has not yet had a 1/2000 scale zoning plan approved by a competent state agency.
The area has a 1/2000 scale zoning plan and architectural management regulations approved, but has expired (after December 31, 2021 according to Article 41 of the 2019 Architecture Law).
The area has a 1/2000 scale zoning plan but there are no architectural management regulations issued by competent authorities.
The Ho Chi Minh City Department of Construction affirmed that, in principle, localities can still base on the 1/2000 scale zoning plan to assess the suitability of land use and planning indicators.
Previously, the Ho Chi Minh City People's Committee issued Official Dispatch No. 2252 dated March 24, 2026, allowing the continued application of current planning projects (including 1/2000, 1/5000 sub-area planning and commune general planning) until they are replaced, expected before December 31, 2027.
To remove obstacles, the Ho Chi Minh City Department of Construction requests the People's Committees of wards, communes and Con Dao special zone to urgently review all difficulties related to planning in the area, including: 1/2000 scale zoning plan; 1/500 scale detailed plan; architectural management regulations.
Localities must propose specific solutions and send reports to the Department of Construction before April 14, 2026.
The Department of Construction said it will coordinate with the Department of Planning and Architecture and other relevant departments and agencies to summarize and report to the Ho Chi Minh City People's Committee for consideration and direction.
In case of not reporting or allowing complaints to arise, the locality will be responsible to the Ho Chi Minh City People's Committee.
